Section 9. The powers granted by this Act are additional and cumu-
lative and the bonds authorized by this Act may be issued notwithstanding
that other laws may provide for the issuance of other bonds or the borrow-
ing of money for the same or similar purposes on the same or other terms
and conditions.

Section 10. The provisions of this Act are severable, and if any of its
provisions shall be held unconstitutional or invalid by any court of compe-
tent jurisdiction, the decision of such court shall not affect or impair any
of the remaining provisions. It is hereby declared to be the legislative
intent that this Act would have been adopted had such unconstitutional
or invalid provisions not been included herein.

Section 11. This Act shall take effect August 15,1968.

Chapter 16
(Bill No. 2)

An Act to authorize the County Council, sitting in Executive Ses-
sion, and subject to the requirements of Section 24-16, et seq., Mont-
gomery County Code, 1965, by resolution to grant a franchise unto
the Baltimore Gas and Electric Company for the laying of gas trans-
mission facilities under the streets and roads of Montgomery County,
Maryland; and to provide by agreement such terms and conditions
for the use of such franchise.

BE IT ENACTED BY THE COUNTY COUNCIL FOR MONTGOMERY
COUNTY, MARYLAND, that—

Section 1. The County Council, subject to the requirements of Sections
24-16 to 24-19, Montgomery County Code, 1965, is hereby authorized and
empowered by resolution duly adopted in executive session to grant a
franchise unto the Baltimore Gas and Electric Company for the laying
of gas transmission facilities under the streets, roads, and rights-of-way
of the County under such terms and conditions as the Council may deem
necessary to promote and secure the health, safety and welfare of the
County.

Section 2. The County is further hereby authorized and empowered
to enter into an agreement setting forth such terms and conditions, re-
lating to the cost, means, method and time for construction, reconstruc-
tion, installation, replacement, restoration of property, bonding and other
incidental matters relating to operation, use and location of said franchise,
as may be deemed necessary for the health, safety and welfare of the
County to effectuate the grant, and regulate the use of said franchise.

Section 3. This Act shall take effect August 15, 1968.
