vided that the board of physicians in this Title provided for, after a
medical examination of such member, shall certify that such member is
mentally or physically incapacitated from the further performance of duty
and that such incapacity is likely to be permanent, and that such member
should be retired. Upon retirement for ordinary disability any permanent
member of the Police [bureau] Department shall be placed upon a pension
roll by the Director of Personnel and he shall receive an ordinary disability
retirement allowance from the Policemen's Special Fund of Baltimore
County which shall be made on the following basis: For any such per-
manent member who has been an employee of the Police [bureau] Depart-
ment for more than five but less than ten years, the ordinary disability
benefit allowance shall be twenty-five percent of the annual salary which
he last received as such employee. For any such permanent member who
has been an employee for more than ten years, an additional two and one-
half percent shall be added for each year above ten years of service, with a
fifty percent ceiling.
21.17. Retirement for permanent disability or twenty years of Serv-
ice.
The Director of Personnel is hereby authorized to retire from the
office in the Police [bureau] Department, any permanent member thereof,
including the chief and the assistant or deputy chief of Police, who has
become permanently disabled while in the active performance of duty or
has performed faithful service in the department for a period of not less
than twenty years, and place the member so retired upon a pension roll
and allow to each pensioner annually an amount equal to one-half the
yearly amount received by him at the time of his retirement, payable in
monthly installments; provided, that no member of the Police [bureau]
Department shall be retired for permanent disability until he shall have
been examined by the board of physicians herein provided for and their
finding as to the disability assigned as reason for a retirement shall have
been certified by them to the Director of Personnel; the physicians serving
on said board shall be designated by the Director of Personnel, subject
to the approval of the personnel and salary advisory board and shall
be five in number, any three thereof constituting a quorum; and they shall
receive such compensation as may be determined by the Administrative
Officer from time to time subject to budget limitations.
21-18. Refund of money paid into the special fund.
Any person who has been an officer or employee of the Police
[bureau] Department for more than ten years, and who has contributed
to the special fund and who for any reason ceases to be such an officer
or employee, shall forthwith be paid by the county a sum of money equal
to that paid into the fund by such officer or employee during the time he
served as such. This section shall apply to any person who ceased to be an
officer or employee of the Police [bureau] Department on or subsequent |
