health, as provided in Article 43 of the Annotated Code of Maryland, title
"Health," although not specifically enumerated herein, except insofar as
the provisions thereof may be inconsistent with the provisions of this
article; such local] board of health shall have the general care of the
sanitary interests of the people of the county; they shall make or cause
to be made sanitary investigation and inquiries respecting the causes of
disease, and especially epidemics and causes of mortality; they shall in-
quire into and investigate, or cause to be inquired into and investigated,
all nuisances affecting the public health, comfort or property of the citi-
zens of the county, or any city, town or village therein; and are authorized
and empowered by information or petition filed in the name of such board,
to apply to the judges, or to any judge of the circuit court for such county,
in term time or vacation, for an injunction to restrain and prevent such
nuisance, no matter by whom or what authority committed; and further,
they shall have full power and authority to preserve the health of the
county, to prevent and remove nuisances, and to prevent the introduction
of contagious diseases within the county.
Sec. 13-10. Authority to make regulations.
For the purpose of protecting the public health, and subject to the
limitations imposed by Section 539 of the Baltimore County Charter, the
board of health of the county may make any regulations in its opinion
necessary, and may from time to time amend or repeal such regulations
and make new regulations:
(1) To provide for the proper inspection of milk, foods, milk
products and food products, or any of them, offered for sale or intended
for consumption in the county;
(2) To provide for the proper inspection of all and any plants,
factories, dairies, bakeries and establishments of any kind or nature,
manufacturing, processing, handling or preparing milk, foods, milk
products or food products, for the purpose, more especially, of ascertaining
their sanitary condition and cleanliness, and for the purpose of ascertain-
ing the purity, healthfulness and wholesomeness of the ingredients or
materials used in preparing the finished product offered for sale in the
county or intended for consumption therein; provided, however, that noth-
ing contained in paragraphs (1) and (2) of this section shall be con-
strued to authorize the board of public health of the county to make any
regulations which differ in any respect from the provisions of Article 43
of the Annotated Code of Maryland, 1957, relating to the sale or prepara-
tion for sale, or inspections of any plants, factories, dairies, bakeries and
establishments of any kind or nature, manufacturing, processing, handling,
preparing or selling milk, foods, milk products or food products as such
article now provides, or may hereafter be amended, or with the regulations
now or hereafter adopted by the state board of health covering the
