1970                              MUNICIPAL CHARTERS

limits not otherwise served, to acquire, construct, improve, enlarge,
operate and maintain, a water supply and distribution system, a sani-
tary sewerage system and treatment plant and a storm water drainage
system; to impose, levy and collect assessments, connection and serv-
ice charges to pay the cost of any such systems and the cost of main-
tenance and operation thereof; to adopt and, from time to time, revise
rules and regulations governing the use of any such systems and the
connection thereto; to acquire by purchase or condemnation real
property necessary for any such systems; to contract to provide water
or sewer service to any public agency or installation on such terms
as may be acceptable; to accept governmental grants or loans for the
acquisition or construction of any such systems on such terms as
may be prescribed; and to exercise within its service area certain of
the powers conferred on the Cecil County Metropolitan Commission
in sanitary districts elsewhere in Cecil County.

Section 1. BE IT RESOLVED BY THE COMMISSIONERS OF
PERRYVILLE, That the Town Charter, as the same appears in the Code
of Public Local Laws of Cecil County (1961 Edition), being Article 8 of
the Code of Public Local Laws of Maryland, title: Cecil County, subtitle:
Perryville, be and the same is hereby amended by adding to said Charter
a new subheading and a new Section, designated Section 312 A, which
shall read as follows:

Water and Sewer Systems

312A. The Commissioners of Perryville are hereby authorized and em-
powered to acquire, by purchase or condemnation, as herein provided, and to
construct, reconstruct, repair and extend, both within the corporate limits of
the Town and in any contiguous area beyond said limits not otherwise
served, a water supply and distribution system, a sanitary sewerage sys-
tem, a storm water drainage system and a sanitary sewage disposal plant,
or the Town may extend, alter and repair any of such existing systems
so established or acquired by it and may operate and maintain any such
system or systems so established, acquired or constructed. In conjunction
with the authority hereby conferred, The Commissioners of Perryville
may take or acquire any land, structures, buildings, water courses, water
rights or other property, either within or outside the municipality, either
in fee or as an easement, for the construction, establishment, extension,
alteration, maintenance or operation of any part or appurtenance of any
of said systems. Such property may be acquired by gift, purchase or con-
demnation, but the taking of any such property by condemnation shall
be conducted in accordance with the provisions of the Public General
Laws of Maryland applicable to the condemnation of property by mu-
nicipal corporations. However, the power hereby conferred shall extend
to any property, right or interest belonging to any person or corporation
whether such corporation be public or private, and whether such prop-
erty, right or interest be impressed with a prior public or
