1928                                 MUNICIPAL CHARTERS

at the same hours and with the same clerks as are required for the gen-
eral municipal election. Any person desiring to become a candidate for
Mayor or City Council shall, at least [ten] twenty days prior to said pri-
mary election, file, or there shall be filed for him, with the City Clerk a
statement of such candidacy in substantially the following form:

"Candidate for Nomination for....................

State of Maryland, Allegany County:

I, ...................., being first duly sworn, say that I (or he) reside at

.................... Street, City of Cumberland, County of Allegany, State of

Maryland; that I (or he) am (or is) a qualified voter therein; that I
(or he) am (or is) qualified to hold; that I (or he) have (or has) re-
sided within the City for at least five years preceding the election; that I

(or he) am (or is) a candidate for nomination to the office of....................

to be voted upon at the primary election to be held on the ........ day of

...................., 19...., and I hereby request that my (or his) name be printed

upon the official primary ballot for a nomination by such primary election
for such office.

Subscribed and sworn to (or affirmed) before me....................on this

.... day of...................., 19.....

Section 2. AND BE IT FURTHER RESOLVED, That a new sub-
section, to be designated as subsection (g) of Section 10 of said Charter
of the City of Cumberland, be and it is hereby enacted to read as follows:

"(g) Special elections called for the purpose of filling vacancies on
the City Council shall be held in accordance with the provisions of this
Section with regard to the filing of candidates, publication and all other
material elements of such election. No primary election need be held and
the candidate or candidates, as the case may be, receiving the highest
number of votes shall be the successful candidates for the office sought."

Section 3. AND BE IT FURTHER RESOLVED, That the date of
the passage of this Resolution is November 4, 1968, and the amendment
of the Charter of the City of Cumberland, hereby enacted, shall become
effective on December 24, 1968, unless a proper Petition for a Ref-
erendum hereon shall be filed as provided by Section 13 of Article 23A
of the Annotated Code of Maryland, and provided a complete and exact
copy of this Resolution shall be continuously posted on the North Centre
Street entrance of the City Hall, Cumberland, Maryland, until December
14, 1968, and provided further that a fair summary of the proposed
amendment shall be published in the Cumberland Evening Times, a news-
paper of general circulation in the City of Cumberland, once in each of
the weeks of November 4, 11, 18, 25, and December 2, 1968.

Section 4. AND BE IT FURTHER RESOLVED, That the Mayor
of the City of Cumberland is hereby specifically directed to carry out the
provisions of Section 3 hereof, regarding the giving of notice by posting
and publication of this
