CUMBERLAND                                          1925

I HEREBY CERTIFY, That the aforegoing Resolution, amending
the Charter of the City of Cumberland, Maryland, was passed this 21st
day of October, 1968, with Four votes in the affirmative and No votes in
the negative.

I HEREBY CERTIFY, That the aforegoing is a true and exact copy
of Charter Amendment Resolution No. 39, passed by the Mayor and City
Council of Cumberland, Maryland, in Regular Session on October 21, 1968.

I FURTHER CERTIFY, That there was no Petition for a Ref-
erendum on the proposed amendment filed within the required time and,
therefore, the same became effective on December 10th, 1968.

Charter Amendment Resolution No. 40

Resolution of the Mayor and City Council of Cumberland, Mary-
land, adopted in pursuance of the authority contained in Article 11-E
of the Constitution of the State of Maryland, and Section 13 of Article
23A of the Annotated Code of Maryland, entitled "Municipal Corpo-
rations," as said Section was enacted by Chapter 423 of the Acts of
the General Assembly of Maryland, 1955, entitled "A Resolution to
amend the Charter of the City of Cumberland, Maryland (1966
Edition), by repealing and re-enacting, with amendments, Section
28 of said Charter, found under the subtitle 'Mayor and Council,'
and dealing with the duties, etc., of the Commissioner of Finance
and Revenue."

Section 1. BE IT RESOLVED BY THE MAYOR AND CITY COUN-
CIL OF CUMBERLAND, MARYLAND, That Section 28 of the Charter
of the City of Cumberland (1966 Edition) be and is hereby repealed and
re-enacted, with amendments, to read as follows:

"Sec. 28. In addition to the duties hereinbefore prescribed for the
Commissioner of Finance and Revenue, he shall also be the Treasurer of
said City, and as such Treasurer shall give bond in such amount and in
such form as may be required by the said Mayor and City Council, in a
sum not less than Twenty Thousand Dollars ($20,000.00) with a surety
company authorized to do business in the State of Maryland as surety (the
cost of same to be paid by the Mayor and City Council of Cumberland),
to be approved by the Mayor and City Council, said bond to be condi-
tioned for the faithful discharge of his duties. It shall be his duty to re-
ceive and keep, as herein provided, all money belonging to the said City,
and to pay out the same only on [warrants] drafts drawn by the Comp-
troller [and signed by the Mayor] signed by him, and countersigned by
the Commissioner of Finance and Revenue, under the seal of said Mayor
and City Council, and not otherwise. All moneys belonging to said City
and received by the Collector, either from taxes, water rents, licenses
or collections, or from any other sources whatsoever, shall be by him de-
posited with the said Treasurer daily, and all other officers shall pay
once in each month not later than the last day thereof, for all moneys
received; the Treasurer shall give duplicate receipts in all c
