1920                              MUNICIPAL CHARTERS

4.  Eligibility. All members of the Cumberland Police Department
who are classified as police officers by Ordinance No. 2559 of the Mayor
and City Council, known as the "personnel ordinance", or by any amend-
ing or succeeding ordinances thereto, shall be eligible to receive benefits
under the terms of this Charter provision to which they may become en-
titled by reason of their service with said department, as hereafter set
forth.

All employees of said department who were so employed during the
period of one (1) year preceding the establishment of this Pension Plan,
shall receive credit for all prior service in said department.

5.  Benefits. Said Pension Plan shall provide benefits for retirement,
both ordinary retirement and retirement occasioned by service connected
or non-service connected disability. Said Plan shall also provide benefits
upon the death of a member, whether such death shall occur during em-
ployment or during retirement.

Said Pension Fund Board shall establish such schedule of benefits as,
in its discretion, shall be advisable and shall prescribe such eligibility
requirements for any of said benefits as, in its discretion, it shall deem
proper. Said Board shall have the authority to increase or decrease any
benefits hereunder as the condition of the Pension Fund at any time
shall require.

6. Funding. Said Pension Plan shall be funded by contributions from
members of said department who are eligible to participate in said Plan
and from contributions from the Mayor and City Council of Cumberland.
The rate of contributions shall be set from time to time by said Board
and may be increased or decreased at the discretion of said Board to
meet current needs of said Pension Plan.

7.  Disposition of Current Fund: Upon the establishment of said Po-
lice Pension Fund, the Pension Fund Board shall assume the responsibility
for administration of the Police Pension Fund currently in existence. The
City Treasurer is hereby directed to transfer the proceeds of said current
fund to said Board for administration. Those persons currently receiving
benefits from said Fund shall continue to receive any benefits to which
they may have become entitled. Upon the death of the last eligible mem-
ber of the said current Fund{ any remaining balance thereof shall be
transferred into the Police Pension Fund hereby created.

Section 3. AND BE IT FURTHER RESOLVED, That the date of
the passage of this Resolution is July 1, 1968, and the amendment of
the Charter of the City of Cumberland, hereby enacted shall become effec-
tive on August 20, 1968, unless a proper Petition for a Referendum
hereon shall be filed as provided by Section 13 of Article 23A of the Anno-
tated Code of Maryland, and provided a complete and exact copy of this
Resolution shall be continuously posted on the North Centre Street en-
trance of the City Hall, Cumberland, Maryland, until August 13th, 1968,
