1914                              MUNICIPAL CHARTERS

I HEREBY CERTIFY, That the aforegoing is a true and exact copy
of Charter Amendment Resolution No. 34, passed by the Mayor and City
Council of Cumberland, Maryland, in Regular Session, on June 17, 1968.

I FURTHER CERTIFY, That there was no Petition for a Referendum
on the proposed amendment filed within the required time and, therefore,
the same became effective on August 6, 1968.

Charter Amendment Resolution No. 35

Resolution of the Mayor and City Council of Cumberland, Maryland,
adopted pursuant to the authority contained in Article 11-E of the
Constitution of the State of Maryland, and Section 13 of Article 23A
of the Annotated Code of Maryland, entitled "Municipal Corpora-
tions," as said section was enacted by Chapter 423 of the Acts of the
General Assembly of Maryland, 1955, entitled, "A Resolution to amend
the Charter of the City of Cumberland, Maryland, (1966 Edition), by
repealing and reenacting, with amendments, Section 30, which is
found under the subtitle 'Mayor and City Council' and deals with the
duties generally of the City Solicitor."

Section 1. BE IT RESOLVED BY THE MAYOR AND CITY COUN-
CIL OF CUMBERLAND, MARYLAND, That Section 30 of the Charter
of the City of Cumberland, under the subtitle "Mayor and Council" and
reads as follows, be and is hereby repealed:

[It shall be the duty of the city solicitor to represent the said Mayor
and City Council in all cases brought for or against the said city in the
courts of the state, or of the United States, in the circuit court and before
the city magistrate. When requested by the Mayor and City Council or
any member thereof, he shall, in writing, give legal advice on all questions
that may be referred to him, and shall also in writing advise the officers of
said city as and when he may be called upon for said advice. He shall
prepare all ordinances and examine, supervise, prepare and approve as to
form, all the contracts, specifications, deeds and all other legal papers and
forms of the said Mayor and City Council, and he shall have general super-
vision over all the legal business of said Mayor and City Council, and shall
attend to all said business. He shall maintain an office in the City Hall
and shall prosecute all city cases in the City police court. He shall be paid
such salary as the Mayor and City Council shall by ordinance direct, and
he shall, when obliged to leave the city on the city's business, receive his
actual expense, in addition to his salary. He shall be not less than twenty-
five years of age, five years a resident of the city and three years a member
of the bar. He shall give bond for the faithful performance of his duties in
the sum of five thousand dollars ($5,000.00) to be approved by the Mayor
and City Council of Cumberland.]

Section 2. AND BE IT FURTHER RESOLVED, That Section 30 of
the Charter of the City of Cumberland (1966 Edition) be and is hereby
reenacted to read as follows:

(a) Pursuant to the authority granted in Section
