the place of the Section so repealed, revising the provisions con-
cerning disciplinary action against practicing optometrists in
this State.
SECTION 1. Be it enacted by the General Assembly of Maryland,
That Section 380 of Article 43 of the Annotated Code of Maryland
(1968 Supplement), title "Health," subtitle "Optometry," be and it
is hereby repealed and that a new Section 380 be and it is hereby
enacted in lieu thereof, to stand in the place of the section so re-
pealed, and all to read as follows:
380.
Board of Examiners of Optometry—Disciplinary Proceedings
(a) Powers and Duties. The Board shall have the power to rep-
rimand cm optometrist or place him on probation, revoke, or suspend
his certificate of registration or examination granted by it under
this subtitle, or dismiss the charges against any optometrist for any
of the causes listed below as urn/professional conduct:
(1) Fraudulent or deceptive procuring or use of a certificate of
registration or examination.
(2) Advertising in any manner which includes or contains any
reference to cost, price, or credit terms of optometric services or of
lenses, glasses, frames, mountings, or other related articles or de-
vices when provided or sold in connection with or as a result of an
optometric examination.
(3) (2) Conviction of a crime involving moral turpitude.
(4) (3) Abandonment of a patient.
(5) (4) Addiction to narcotics, habitual drunkenness or rendering
optometric services to a patient if the optometrist is intoxicated or
under the influence of drugs.
(6) (5) Promotion by an optometrist of the sale of devices, appli-
ances or goods provided for a patient in such a manner as to exploit
the patient for financial gain of the optometrist.
(7) (6); Immoral conduct of an optometrist in his practice as an
optometrist.
(8) (7) Willfully making and filing false reports or records, in his
practice as an optometrist.
(9) (8) Willful omission to file or record, or willfully impeding or
obstructing a filing or recording, or inducing another person to omit
to file or record optometric reports required by law.
(10) (9) Failure to furnish details of a patient's optometric record
to succeeding optometrists upon proper request, OF THE PATIENT.
(11) (10) Solicitation of patronage by agents or persons, or profit-
ing from the acts of those representing themselves to be agents of
