1968 Cumulative Supplement), title "Crimes and Punishments," to
be under a new subtitle "Health—Unsolicited Mailing of Drug Prod-
ucts,"
DRUGS," to follow immediately after Section 313B thereof,
and to read as follows:

HEALTH—UNSOLICITED MAILING OF DRUG PRODUCTS
DRUGS

313BA.

It shall be unlawful for any person, persons, firm or corporation
within this State to advertise drug products by unsolicited mailing
TO MAIL ANY DRUG AS DEFINED IN SECTION 313B (A) (3)
OF THIS ARTICLE or by bulk mailing to "Resident," "Occupant,"

or to named addressees whose names have been obtained from city

directories, telephone directories or other listings obtainable. OR TO
A NAMED ADDRESSEE WHOSE NAME HAS BEEN OB-
TAINED FROM A CITY DIRECTORY, TELEPHONE DIREC-
TORY OR
OTHER LISTING OBTAINABLE. WHO HAS NOT
REQUESTED THAT SUCH DRUG BE MAILED TO HIM. Any
person, or if a firm or corporation, it and all its agents, who shall
violate any of the provisions of this section shall be deemed guilty of
a misdemeanor, and upon conviction thereof shall be punished by a
fine not to exceed five hundred dollars ($500.00), or by imprison-
ment in jail not to exceed six months, or by both fine and imprison-
ment.
THE PROVISIONS OF THIS SECTION SHALL NOT
APPLY TO THE MAILING OF ANY DRUGS TO THOSE PER-
SONS, INSTITUTIONS OR CORPORATIONS WHO UNDER THE
LAWS OF MARYLAND ARE PERMITTED TO DISBURSE,
PRESCRIBE OR ADMINISTER SUCH DRUGS.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1969.

CHAPTER 797
(House Bill 447)

AN ACT to repeal and re-enact, with amendments, Section 9 of
Article 41 of the Annotated Code of Maryland (1968 Supplement),
title "Governor—Executive and Administrative Departments,"
subtitle "General Provisions," AND SECTION 246(A) OF THE
SAME ARTICLE, TITLE, SUB-TITLE "ADMINISTRATIVE
PROCEDURE ACT," amending the laws concerning the filing of
copies of certain rules and regulations in order to add the State
Library AND THE LIBRARIES OF THE RESPECTIVE CIR-
CUIT COURTS OF THE SEVERAL COUNTIES AND THE
SUPREME BENCH OF BALTIMORE CITY AND CORRECTING
AN ERROR to the lists of agencies with which these rules and
regulations must be filed, and to remove the Secretary of State from
said list,
AND CORRECTING AN ERROR.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 9 of Article 41 of the Annotated Code of Maryland
