CHAPTER 730
(House Bill 1102)

AN ACT to repeal and re-enact, with amendments, Section 54 of
Article 77 of the Annotated Code of Maryland (1965 Replacement
Volume), title "Public Education," subtitle "Chapter 5. County
Board of Education," requiring the Board of Education of
Dorchester, CAROLINE, TALBOT, CALVERT, CHARLES, ST.
MARY'S, WORCESTER and Queen Anne's Counties to contract
with independent contractors for required school bus
transporta-
tion. REQUIRING THE USE OF INDEPENDENT CONTRAC-
TORS IN SEVERAL COUNTIES OF THE STATE FOR TRANS-
PORTATION OF SCHOOL CHILDREN, PROVIDING FOR THE
NUMBER OF PUBLICLY OWNED BUSES AND THE EFFECT
OF PRIVATE CONTRACTOR USE ON STATE FUNDS FOR
EDUCATION IN THESE COUNTIES.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 54 of Article 77 of the Annotated Code of Maryland
(1965 Replacement Volume), title "Public Education," subtitle
"Chapter 5. County Board of Education," be and it is hereby repealed
and re-enacted, with amendments, to read as follows:

54.

The county board of education shall to the best of its ability
cause the provisions of this article, the bylaws, and the policies of
the State Board of Education to be carried into effect. Subject to
this article, and to the bylaws, and the policies of the State Board
of Education, the county board of education shall determine, with
and on the advice of the county superintendent, the educational
policies of the county and shall prescribe rules and regulations for
the conduct and management of the schools. In Dorchester, CARO-
LINE, TALBOT, CALVERT, CHARLES, ST. MARY'S, WORCES-
TER and Queen Anne's Counties the respective county boards
of education shall contract with independent contractors for buses
and operators required to transport students and/or teachers.
EACH
OF THE ABOVE COUNTIES MAY OWN A TOTAL OF NOT
TO EXCEED TEN (10) BUSES. IN THESE COUNTIES THE
USE OF INDEPENDENT CONTRACTORS SHALL NOT HAVE
ANY EFFECT ON THE AMOUNT OF STATE FUNDS PRO-
VIDED FOR SCHOOL BUS TRANSPORTATION.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1969.
