(b) Compensation shall be payable for silicosis, asbestosis or
other pulmonary dust disease in the same manner as provided in
Section 36(4) of this article for other cases of disability. In the event
of total disability or death from silicosis, asbestosis, or other pul-
monary dust disease, compensation shall be payable to employees
and their dependents in the same manner and in the amounts as
required to be paid by employers to employees and their dependents,
who are totally disabled or die from injuries arising out of and in
the course of their employment as provided in Section 36 of this
Article.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1969.

CHAPTER 720
(House Bill 1035)

AN ACT to repeal and re-enact, with amendments, Section 91 (b) of
Article 101 of the Annotated Code of Maryland (1964 Replace-
ment Volume and 1968 Supplement), title "Workmen's Compen-
sation," subtitle "Uninsured Employer's Fund," to clarify the
provisions relating to when assessments in death cases may be
made under this subtitle.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 91 (b) of Article 101 of the Annotated Code of Mary-
land (1964 Replacement Volume and 1968 Supplement), title "Work-
men's Compensation," subtitle "Uninsured Employer's Fund," be
and it is hereby repealed and re-enacted, with amendments, to read
as follows:

91.

(b) For the purpose of establishing and maintaining this fund,
the Commission, upon rendering a decision with respect to any claim
for compensation against an uninsured employer as defined in Sec-
tion 102 of this article shall impose an assessment in the sum of one
hundred fifty dollars ($150.00) against the employer and direct its
payment into the fund in connection with each such claim wherein
injury shall have occurred on or after the first day of January,
1968, or in death cases, where death [as the result of injury shall
have occurred] is the result of an injury occurring on or after
said date. The Commission shall also impose an additional assess-
ment of fifteen per centum (15%) of the award or awards made in
each such claim, such additional assessment not to exceed, however,
the sum of one thousand five hundred dollars ($1,500.00) in any one
claim, and shall direct that such additional assessment also be paid
into the fund.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1969.
