County shall be responsible for the administration and enforcement
of this Act, the County Commissioners acting as the local board of
health shall upon the request of the Deputy State Health Officer
assist him in the administration and enforcement of this Act.

Sec. 3. And be it further enacted, That this Act shall take effect
July 1, 1969.

CHAPTER 698
(House Bill 878)

AN ACT to repeal Section 111 of Article 66˝ of the Annotated Code
of Maryland (1967 Replacement Volume), title "Motor Vehicles,"
subtitle "Administration—Registration—Titling," and to enact
new Section 111, in lieu thereof, to stand in the place of the sec-
tion repealed, to make the filing of an application for a driver's
license under a false or fictitious name where the applicants driver's
license has been refused, cancelled, suspended or revoked
UNDER
CERTAIN CIRCUMSTANCES a felony MISDEMEANOR FEL-
ONY and providing penalties for this offense.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 111 of Article 66˝ of the Annotated Code of Mary-
land (1967 Replacement Volume), title "Motor Vehicles," subtitle
"Administration—Registration—Titling," be and it is hereby re-
pealed, and that new Section 111, be and it is hereby enacted in
lieu thereof, to stand in the place of the section being repealed,
and to read as follows:

111.

(a) Any resident or non-resident, of Maryland, whose operator's
or chauffeur's license or other driving privilege has been refused,
cancelled, suspended, or revoked for any reason as provided in this
article, or as provided in the applicable law of the jurisdiction which
issued the non resident's license or other driving privilege
AS PRO-
VIDED IN THIS ARTICLE, OR AS PROVIDED IN THE APPLI-
CABLE LAW OF THE JURISDICTION WHICH ISSUED THE
NON-RESIDENT'S LICENSE OR OTHER DRIVING PRIVILEGE
BECAUSE SUCH PERSON PRIOR THERETO HAS BEEN CON-
VICTED OF OR HAS FORFEITED COLLATERAL FOR AN
OFFENSE OR OFFENSES COMMITTED IN MARYLAND OR
ANOTHER JURISDICTION, and who thereafter fraudulently uses
a false or fictitious name in any application for an operator's or chauf-
feur's license or for any other driving privilege shall be guilty of a
felony
MISDEMEANOR FELONY, and upon conviction shall be
punished by a fine of not less than one hundred ($100.00) dollars, nor
more than one thousand ($1,000.00) dollars or imprisonment for not
more than ten (10)
THREE (3) TEN (10) years or by both fine and
imprisonment in the discretion of the court.
