Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1969.

(House Bill 860)

AN ACT to add new Section 441 to the Code of Public Local Laws of
Cecil County (1961 Edition, being Article 8 of the Code of Public
Local Laws of Maryland), title "Cecil County," new subtitle "Com-
mercial Haulers of Refuse," to follow immediately after Section
440 thereof, providing that it shall be unlawful for anyone to
engage in the business of refuse collection in Cecil County without
first qualifying as a licensed commercial hauler, authorizing the
Deputy State Health Officer for Cecil County to regulate and to
require the licensing of all haulers engaged in the business of
collecting refuse in Cecil County and providing generally there-
for, including a penalty for non-compliance with this Act.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 441 be and it is hereby added to the Code of Public
Local Laws of Cecil County (1961 Edition, being Article 8 of the
Code of Public Local Laws of Maryland), title "Cecil County," to
follow immediately after Section 440 thereof and to be under
the new subtitle "Commercial Haulers of Refuse," and to read as
follows:

(a)    It shall be unlawful for any person, firm or corporation who
is a commercial hauler of refuse, as defined in this section, to engage
in the collection of refuse in Cecil County without first qualifying
in that county as a licensed commercial hauler as hereinafter
provided.

(b)    A commercial hauler of refuse shall be defined as a hauler
who is engaged in the business of collecting refuse, garbage, trash
or other types of waste in Cecil County.

(c)    The Deputy State Health Officer for Cecil County shall be
responsible for the issuance of collection licenses to commercial
haulers of refuse and shall issue the license only if the commercial
hauler has paid the required fee and has fully complied with the
rules and regulations as established by the Health Officer; provided,
however, that a commercial hauler engaged in the business of refuse
collection in Cecil County as of July 1,1969, shall have one year from
that date to comply with these rules and regulations.

(d)    The Health Officer shall promulgate rules and regulations
relating to the proper receptacles to be used, workmen's compensa-
tion, display of licenses and any other matters that he may deem
