and which contract obligates the purchaser to make or pay an initial
deposit prior to the completion of the home, the builder or seller
shall either obtain a corporate surety bond in an amount equal to the
deposit or hold the deposit in an escrow account in order to guarantee
return of the deposit to the purchaser in the event the purchaser
becomes entitled to a return of such deposit. The surety bond or
escrow account shall be maintained until such time as the deed to
the new home is delivered to the purchaser, his heirs or assigns or
until the deposit is returned to the purchaser,
EXCEPT WHERE
DEPOSIT IS FORFEITED DUE TO THE FAULT OF THE
BUYER.

(b) Failure to obtain and maintain either a corporate surety
bond or an escrow account as provided for in subsection (A) of this
section is a misdemeanor, and is punishable, upon conviction, by a
fine not to exceed mm thousand dollars ($1,000.)
FIVE HUNDRED
DOLLARS ($500.00) or imprisonment not to exceed mm year
NINETY DAYS or both. If the violations is by a corporation, then
any officer, director, or employee who knowingly violates this Act
is subject to the penalties of this subsection.

(C) PROVIDED, HOWEVER, THIS SECTION SHALL NOT
APPLY IF THE DEPOSIT IS HELD BY A LICENSED REAL
ESTATE BROKER.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1969.

CHAPTER 668
(House Bill 535)

AN ACT to add new Section 235A to Article 18 of the Code of
Public Local Laws of Maryland (1930 Edition), title "Queen Anne's
County," subtitle "Foxes," to follow immediately after Section 235
thereof; and to repeal and re-enact, with amendments, Section 236
of said Article and Code, as last amended by Chapter 231 of the
Acts of 1957, to make it unlawful to hunt, shoot, or trap any fox
in the Fourth Election District from sunset to sunrise and to
provide a penalty for violation of this provision.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 235A be and it is hereby added to Article 18 of
the Code of Public Local Laws of Maryland (1930 Edition), title
"Queen Anne's County," subtitle "Foxes," to follow immediately
after Section 235 thereof; and that Section 236 of said Article and
Code, as last amended by Chapter 231 of the Acts of 1957, be and it
is hereby repealed and re-enacted, with amendments, and all to read
as follows:

235A.

It shall be unlawful to hunt, shoot, or trap any fox in the Fourth
Election District from sunset on any day to sunrise on the following
day.
