CHAPTER 647
(House Bill 272)

AN ACT to repeal and re-enact, with amendments, Section 307 of
Article 77 of the Annotated Code of Maryland (1965 Replace-
ment Volume), title "Public Education," subtitle "Nonpublic
Schools," to provide that the form used for enrollment contracts
must be approved by the State Superintendent and , that any note
executed in connection therewith be mentioned in the contract and
attached thereto. , AND THAT NO CONFESSED JUDGMENT
CLAUSE IN ANY SUCH CONTRACT SHALL BE VALID.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 307 of Article 77 of the Annotated Code of Maryland
(1965 Replacement Volume), title "Public Education," subtitle
"Nonpublic Schools," be and it is hereby repealed and re-enacted,
with amendments, to read as follows:

307.

(a) The State Superintendent is authorized to promulgate such
rules and regulations, not inconsistent with the provisions of this
subtitle, as may be necessary to supplement and implement the pro-
visions thereof.

(B) No enrollment contract offered by a solicitor, required to
secure a permit under Section 306 of this article, to a prospective stu-
dent shall be valid unless executed on a form approved by the State
Superintendent. If a note is to be executed in connection with the
payment of tuition or fees set forth in the enrollment contract, it
shall be referred to in and attached to the enrollment contract.
PRO-
VIDED, HOWEVER, THAT NO CONFESSED JUDGMENT
CLAUSE IN ANY SUCH CONTRACT SHALL BE VALID.

(b) No enrollment contract offered by a solicitor, required to
secure a permit 306, to a prospective student shall not be valid unless
executed on a form approved by the State Superintendent. If a note

is to be executed in connection with the payment of tuition or fees
set forth in the enrollment contract, it shall be referred to in and
attached to the enrollment contract.

SEC. 2. And be it further enacted, That this Act shall take effect

July 1, 1969. AND BE IT FURTHER ENACTED, THAT NO
PRESENTLY EXISTING OBLIGATION OR CONTRACT RIGHT
SHALL IN ANY WAY BE IMPAIRED BY THE PROVISIONS
OF THIS ACT.

SEC. 3. AND BE IT FURTHER ENACTED, THAT THIS ACT
SHALL TAKE EFFECT JULY 1, 1969.
