(House Bill 225)

AN ACT to repeal and re-enact, with amendments, Sections 9(h),
9A(a), 14(h) and 14A(b) of Article 2B of the Annotated Code
of Maryland (1968 Replacement Volume) title "Alcoholic Bever-
ages," subtitles "Beer Licenses" and "Beer and Light Wine Li-
censes," to prohibit the issuance of a Class B or Class H Beer
License or Class B or Class H Beer and Light Wine License in
Montgomery County to any restaurant located within a bowling
alley, drugstore or billiard hall or for use upon any premises
which has a passageway providing direct public access to any
bowling alley, billiard hall or drugstore.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 9(h), 9A(a), 14(h) and 14A(b) of Article 2B of the
Annotated Code of Maryland (1968 Replacement Volume) title
"Alcoholic Beverages," subtitles "Beer Licenses" and "Beer and Light
Wine Licenses," are hereby repealed and re-enacted with amendments
to read as follows:

9. Beer license, Class B (on sale)—Hotels and restaurants.

(h) Montgomery County.—In Montgomery County the annual
license fee for such license shall be two hundred and fifty dollars
($250.00), [except no license shall be issued to any restaurant
located within a bowling alley, drugstore or billiard hall.] except
no license shall be issued to, or for use in conjunction with, or upon
the premises of any restaurant located within a bowling alley, drug-
store or billiard hall or for use upon any premises which has a door,
archway, opening or other passageway providing direct public access
to any bowling alley, billiard hall or drugstore.

9A. Beer license, Class H (on sale only)—Hotels and restaurants.

(a) General provisions.—A Class II beer license shall be issued
by the clerk of the circuit court of the county in which the place of
business is located, and shall authorize the holder thereof to keep for
sale and sell beer at retail at any hotel or restaurant at the place
therein described, for consumption on the premises. The annual fee
for such license shall be two hundred dollars ($200.00) and shall be
payable to said clerk, before any such license is issued, for distribu-
tion as hereinafter provided, [except no license shall be issued to any
restaurant located within a bowling alley, drugstore or billiard hall.]
