Sec. 3. 4. And be it further enacted, That this Act shall take effect
July 1, 1969.

(House Bill 164)

AN ACT to add new Sections 725 to 742, inclusive, to Article 43 of
the Annotated Code of Maryland (1965 Replacement Volume and
1968 Supplement), title "Health," to follow immediately after
Section 724 thereof and to be under the new subtitle "Hearing
Aids," placing the registration and regulation of persons furnish-
ing hearing aids under the Board of Examiner's for Hearing Aid
Dealers, making general provisions for the regulation of persons
and agencies furnishing and selling hearing aids in this State, and
relating generally to the selling, dispensing, and use of hearing
aids.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Sections 725 to 742, inclusive, be and they are hereby
added to Article 43 of the Annotated Code of Maryland (1965 Re-
placement Volume and 1968 Supplement), title "Health," to follow
immediately after Section 724 thereof, to be under the new subtitle
"Hearing Aids," and to read as follows:

Hearing Aids
725. Definitions.
As used in this subtitle, unless the context otherwise requires:

(1)  "Board" means the Board of Examiners for Hearing Aid
Dealers.

(2)    "Certificate of registration" includes a temporary certificate
of registration.

(3)    "Hearing aid" means any instrument or device designed for
or represented as aiding, improving, or correcting defective human
hearing and any parts, attachments, or accessories of such an instru-
ment or device.

(4) "Practice of fitting hearing aids" means the evaluation or
measurement of the powers or
range of human hearing by means of

an audiometer or by any other means devised and the consequent

selection or adaptation or sale of hearing aids intended to compen-
sate for hearing loss.

(4) "PRACTICE OF FITTING AND DEALING IN HEAR-
ING AIDS" SHALL MEAN THE MEASUREMENT OF HUMAN
HEARING BY MEANS OF AN AUDIOMETER OR BY ANY
OTHER MEANS SOLELY FOR THE PURPOSE OF MAKING
SELECTIONS, ADAPTATIONS OR SALE OF HEARING AIDS.
THE TERM ALSO INCLUDES THE MAKING OF IMPRES-
SIONS FOR EARMOLDS. A DEALER, AT THE REQUEST
