levied to pay the cost of said improvements, or any reasonable por-
tion thereof, as determined by the County Commissioners; provided
that no assessment shall exceed ten per centum (10%) of the as-
sessed value of the property after giving effect to benefits accruing
thereto from the improvement for which assessed.

Any interested person feeling aggrieved by the levying of any
benefit assessment under this section shall have the right to appeal
to the Circuit Court for Allegany County within thirty days after
the final adoption of the ordinance by the County Commissioners,
and such court, sitting without a jury, is authorized to hear and
determine whether the County Commissioners acted pursuant to the
authority granted herein and whether the benefit assessments levied
pursuant to the provisions of this Act are imposed according to law.

The authority extended to the County Commissioners by this
section shall be in addition to, but not in substitution of, the powers
heretofore vested in them for the improvement of roads in Allegany
County.
Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1969.

(Senate Bill 322)
AN ACT to repeal and re-enact, with amendments, Sections 46C (c)
and (d) of Article 40 of the Annotated Code of Maryland (1968
Supplement), title "General Assembly," subtitle "Subdistricts for
the Senate," to change the eighth election ward in the City of
Annapolis from Senatorial subdistrict No. 6B to Senatorial dis-
trict No. 6C in Anne Arundel County; and correcting an error
therein.
Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 46C (c) and (d) of Article 40 of the Annotated Code
of Maryland (1968 Supplement), title "General Assembly," subtitle
"Subdistricts for the Senate," be and they are hereby repealed and
re-enacted, with amendments, to read as follows:
46C.
(c) Senatorial subdistrict No. 6B is composed of that area located
in [the City of Annapolis and comprising its eighth election ward
(more particularly described in the City Code of Annapolis) and]
the area within Anne Arundel County within the following boun-
daries: beginning at the boundary of Anne Arundel County with
Baltimore County at Old Annapolis Road (Route 648); thence
easterly along said boundary to its intersection with the boundary
of Baltimore City; thence southerly and easterly along said boundary
