(Senate Bill 40)
AN ACT to repeal Sections 342 through 348, inclusive, of Article 23
of the Annotated Code of Maryland (1966 Replacement Volume),
title "Corporations," subtitle "III. Particular Classes of Corpora-
tions," subheading "Police," and to repeal Sections 60 through 70,
inclusive, of Article 41 of the Annotated Code of Maryland (1965
Replacement Volume and 1968 Supplement), title "Governor—
Executive and Administrative Departments," subtitle "Special
Policemen," and to enact new Sections 60 through 70, inclusive, in
lieu thereof, to stand in the place of the sections so repealed, to
provide for the qualification, investigation, and appointment of
special policemen; to designate the Superintendent of the Mary-
land State Police as the investigating agency and provide for his
powers and duties in relation to special policemen; to provide for
the term of special police commissions and other matters gen-
erally relating thereto.
Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 342 through 348, inclusive, of Article 23 of the Anno-
tated Code of Maryland (1966 Replacement Volume), title "Cor-
porations," subtitle "III. Particular Classes of Corporations," sub-
heading "Police," be and they are hereby repealed and that Sections
60 through 70, inclusive, of Article 41 of the Annotated Code of
Maryland (1965 Replacement Volume and 1968 Supplement), title
"Governor—Executive and Administrative Departments," subtitle
"Special Policemen," be and they are hereby repealed and that new
Sections 60 through 70, inclusive, be and they are hereby enacted in
lieu thereof, to stand in the place of the sections so repealed, all to
read as follows:

The Governor may appoint and deputize as special policemen per-
sons he deems qualified for special police commissions. A commission
shall be issued for each individual approved by the Governor. The
commission shall indicate the period the commission is to be in force
as well as the property it is intended to cover or the purpose for
which it was issued.

Application for a special police commission shall be made to the
Superintendent of the Maryland State Police upon such form as he
prescribes. An application shall be made by the employer of the
person to be commissioned and shall be required for each individual
for whom a special police commission is desired. All persons to be
commissioned shall be at least 21 years of age. The application shall
be accompanied by a fee of $25 to cover the cost of investigation of
the applicant. The fee is nonrefundable if the application is denied.
In no case shall a fee be charged any agency of the State of Maryland,
either the initial or renewal fee.
