(7) Degree of financial hardship on property owner in providing
non State share of cost of project.

(f) The Department of Chesapeake Bay Affairs within the limit
of the funds specified in Section 758 of this Article shall contract for
the construction of all projects in
BE GUIDED IN CONTRACTING
FOR CONSTRUCTION OF ALL PROJECTS BY the order of prior-
ity assigned to them by the Maryland Geological Survey.

758.

(a)    The Department of Chesapeake Bay Affairs shall include
annually in its operating budget from general funds a sum for shore
erosion control projects not to exceed five hundred thousand dollars
($500,000) to provide funds to pay for the State's share of the projects.

NOT EXCEED fifty percent (50%) of the total cost of any THAT
project. THE STATE MAY PARTICIPATE FINANCIALLY IN
ANY APPROVED PROJECT, WITHIN BUDGETARY LIMITA-
TIONS, BY ANY ONE OF THE ALTERNATIVE METHODS ENU-
MERATED IN SECTION 758A OF THIS ARTICLE. ANY PROP-
ERTY OWNER WHO APPLIES FOR STATE AID UNDER THE
PROVISIONS OF SECTION 757 OF THIS ARTICLE MAY INDI-
CATE HIS PREFERENCE FOR STATE PARTICIPATION AC-
CORDING TO ONE OR ANOTHER OF THE ALTERNATE
METHODS ENUMERATED IN SECTION 758A OF THIS ARTI-
CLE; HOWEVER, THE DEPARTMENT OF CHESAPEAKE BAY
AFFAIRS SHALL BE THE SOLE JUDGE OF WHICH SUCH
ALTERNATIVE METHOD IS IN THE BEST INTERESTS OF
THE STATE, AND SHALL MAKE FINAL DETERMINATION
OF THE METHOD BY WHICH STATE AID SHALL BE
GRANTED. FUNDS FOR IMPLEMENTATION OF THIS SUB-
TITLE DURING FISCAL YEAR 1970 SHALL BE LIMITED
TO THOSE PROVIDED BY CHAPTER — OF THE ACTS
OF THE GENERAL ASSEMBLY OF 1969 (SENATE BILL
NO. 402).

(b)    If in any fiscal year the total sum specified in subsection (a)
of this section has not been committed for approved projects, any
remaining amounts of this total sum may be committed for approved
projects which meet all of the requirements of Sections 757 through
759
758A, inclusive, of this Article but which are not located within
either physiographic units or shore erosion control districts.

(a) Notwithstanding the provisions of Section 12(a) of Article

96A of this Code as amended from time to time, no permit shall be

required from the Department of Water Resources for the con-

struction of any State -aided shore erosion control project.

THE STATE MAY SHARE THE COST OF APPROVTD AP-
PROVED SHORE EROSION CONTROL PROJECTS BY ANY ONE
OF THE FOLLOWING ALTERNATIVE METHODS:
