shall hold its sessions in the City of Annapolis and at such time or
times as it shall from time to time by rule prescribe. Its session or
sessions shall continue not less than ten months in each year if the
business before it shall so require. The salary of each judge of the
Court of Special Appeals shall be that prescribed in Section 47 (a-1)
of this Article and shall not be diminished during his continuance in
office. Four of the judges shall constitute a quorum, and the con-
currence of a majority of the entire Court shall be necessary for the
decision of any cause. Nothing herein contained shall authorize the
Court to sit in one or more panels or divisions.

The General Assembly may from time to time provide by law for
additional judges of the Court of Special Appeals and designate the
special appellate judicial circuits from which such judges shall be ap-
pointed [and elected]. Whenever provision is so made by the General
Assembly another judge of the Court of Special Appeals shall [, sub-
ject to the provisions of Section 5 of Article IV of the Constitution,
be elected by the voters of said appellate judicial circuit, who] be
appointed by the Governor and submitted for confirmation by the
Senate. He
shall be subject to the same constitutional provisions,
hold his office for the same term [of years], receive the same com-
pensation and have the same powers as are or shall be provided by
the Constitution or laws of this State for the judges of the Court of
Special Appeals.

Sec. 2. And be it further enacted, That this Act shall take effect
on the same date as, and conditioned upon the approval and adoption
by the voters of the State of the amendment to Article IV of the
Constitution of Maryland proposed at the 1969 Regular Session of
the General Assembly and providing for the appointment and con-
firmation by the Senate of judges.

(House Bill 39)

AN ACT to repeal Section 758 of Article 66C of the Annotated Code
of Maryland (1967 Replacement Volume and 1968 Supplement),
title "Natural Resources," subtitle "Shore Erosion Control," and to
enact new Sections 757 759 758A, inclusive, in lieu thereof, to stand
in the place of the section repealed, and to repeal and re-enact, with

amendments, Section 12(a) of Article 96A of said Code (1964

Replacement Volume and 1968 Supplement), title "Water Re-
sources," subtitle "Appropriation of Waters; Reservoirs and
Dams," to revise the program under which the State participates
financially in the construction of shore erosion control projects;
and to except shore erosion control structures for which State aid
is provided from the necessity of obtaining a permit for their
construction from the Department of Water Resources.
