180.

The fact that any section, subsection, sentence, clause or phrase of
this Act is declared unconstitutional or invalid for any reason shall
not affect the remaining portions of this Act.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1969.

CHAPTER 431
(Senate Bill 295)

AN ACT to repeal Sections 161-170, inclusive, of Article 56 of the
Annotated Code of Maryland (1968 Replacement Volume), title
"Licenses," subtitle "Intelligence Officers and Employment Agen-
cies," and to enact new Sections 161-170, inclusive, in lieu thereof,
to stand in place of the sections repealed, AND TO RENAME
THIS SUBTITLE "FEE-CHARGING EMPLOYMENT AGEN-
CIES," providing for the licensing, regulation and inspection of
Private, Fee-Charging Employment Agencies and providing pen-
alties for the violation of any of the provisions hereof.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 161-170, inclusive, of Article 56 of the Annotated Code
of Maryland (1968 Replacement Volume), title "Licenses," subtitle
"Fee-Charging Employment Agencies," be and they are hereby re-
pealed and that new Sections 161-170, inclusive, be and they are
hereby enacted in lieu thereof, to stand in place of the sections re-
pealed, AND THAT SAID SUBTITLE IS HEREBY RENAMED
"FEE-CHARGING EMPLOYMENT AGENCIES," to read as
follows:

FEE-CHARGING EMPLOYMENT AGENCIES
161.

No person, firm or corporation shall open, operate, or maintain
an Employment Agency in this State without first obtaining a license
for that purpose from the Commissioner of the Department of Labor
and Industry. Any person, firm or corporation opening, operating
or maintaining an employment agency without first obtaining a
license for that purpose from the Commissioner of Labor and Indus-
try shall be guilty of a misdemeanor, and upon conviction thereof
shall be subject to a fine not to exceed one thousand dollars or to
imprisonment not to exceed one year, or both such fine and imprison-
ment.

"Employment Agency" means any individual, partnership, asso-
ciation, corporation, contractor or subcontractor who, for a fee,
procures or offers or attempts to procure employees for persons seek-
ing the service of employees, or employment for persons seeking
