and on July 1 of each year thereafter the balance of monies in this
fund IN EXCESS OF FIFTY THOUSAND DOLLARS ($50,000.00)
shall be paid over to the general funds of the State.
Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1969.

CHAPTER 417
(Senate Bill 685)
AN ACT to repeal and re-enact, with amendments, Section SEC-
TIONS 26 (B) AND 27 of Article 96A of the Annotated Code of
Maryland (1968 Supplement), title "Water Resources," subtitle
"Pollution Abatement," to increase the penalty for violations of
rules, regulations or orders of the Department of Water Resources
in regard to prevention of water pollution.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section SECTIONS 26 (B) AND 27 of Article 96A of the An-
notated Code of Maryland (1968 Supplement), title "Water Re-
sources," subtitle "Pollution Abatement," be and it is THEY ARE
hereby repealed and re-enacted, with amendments, to read as follows:
26.
(B) ANY PERSON WHO VIOLATES SUBSECTION (A) OF
THIS SECTION IS GUILTY OF A MISDEMEANOR, AND UPON
CONVICTION SHALL BE PUNISHED BY A FINE OR BY IM-
PRISONMENT OR BY BOTH FINE AND IMPRISONMENT, FOR
EACH OFFENSE AS PROVIDED IN SECTION 27 OF THIS
ARTICLE. AND ANY VESSEL FROM WHICH OIL IS DIS-
CHARGED IN VIOLATION OF SUBSECTION (A), SHALL BE
LIABLE FOR THE PECUNIARY PENALTY AS SPECIFIED IN
THIS SECTION, AND CLEARANCE OF SUCH VESSEL FROM
A PORT OF THE STATE MAY BE WITHHELD UNTIL THE
PENALTY IS PAID, AND SAID PENALTY SHALL CONSTI-
TUTE A LIEN ON SUCH VESSEL.
27.
Any person found guilty of violating THE PROVISIONS OF
THIS SUBTITLE OR any duly authorized rule, regulation or order
of the Department shall be deemed guilty of a misdemeanor and
upon conviction thereof, each violation shall be punished by fine of
not more than [five hundred dollars ($500.00)] ten thousand dollars
($10,000) and costs of prosecution, or by imprisonment not to
exceed ninety (90) days, ONE (1) YEAR, or both such fine and
imprisonment in the discretion of the court. Each day, upon which a
violation of the provisions of this subtitle shall occur, may be deemed
a separate and additional violation for the purpose of this subtitle.
It shall be the duty of the Attorney General of the State of Maryland
to take charge of and prosecute all cases arising under the provisions
of this subtitle, including the recovery of penalties.
