Moses Fenton Dft }     Moses ffenton late of Somerset County was

high Sheriff of Somerset County of a plea of Trespass on the Case &ca.

and whereupon the sd Ephraim by Peter Dent his Attorney Complaineth

that whereas the said Moses the 10^th day of July of the year of o^r Lord 1693

at Monocan within the Jurisdiction of this Court was indebted to the

said Ephraim in the Sum of nine hundred Sixty & five pounds of tob.–

for Sundry goods & Merchandizes by y^e Said Ephraim to the sd Moses –

Sold & delivered & the sd Moses to the sd Ephraim in manner afd being

indebted did assume upon himself & to y^e sd Ephraim faithfully promise y^t

he the sd Moses the Said Sum of 965 pounds of tobacco to the sd Ephraim

would well & truely Content & pay Nevertheless the sd Moses his p^rmise

& assumption not regarding but minding & fraudulently intending

him the said Ephraim Craftily & Subtily to deceive & defraud the same to

the said Ephraim hath not paid although the Said Moses to doe y^e Same

by the Sd Ephraim hath been requested but y^e Same to doe hath refused &

doth still refuse to the damage of the Said Ephraim of 1800 Pounds of

Tobacco & thereof he brings his Sute &ca.                  Jn^o Doe
