land of others. Provided, however, that nothing contained herein
shall preclude the mayor and city council of Baltimore from enact-
ing legislation making it unlawful or prohibitory to refuse, withhold
from or deny to any person because of his race, creed, color or na-
tional origin any accommodations, advantages, facilities or privi-
leges of any place or places whose facilities, accommodations, serv-
ices, commodities or use are offered to or enjoyed by the general
public, either with or without charge.
Sec. 2. And be it further enacted, That the provisions of this Act
shall not apply to any crimes committed prior to the effective date
of the Act.
Sec. 3. And be it further enacted, That this Act shall take effect
July 1, 1968.

AN ACT to repeal and re-enact, with amendments, Section 82 (e)
of Article 100 of the Annotated Code of Maryland (1964 Replace-
ment Volume and 1967 Supplement), title "Work, Labor and
Employment," subtitle "Wage and Hour Law," to exempt from
the term "employee" under the wage and hour laws certain
students in special education courses.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 82 (e) of Article 100 of the Annotated Code of Mary-
land (1964 Replacement Volume and 1967 Supplement), title "Work,
Labor and Employment," subtitle "Wage and Hour Law," be and
it is hereby repealed and re-enacted, with amendments, to read as
follows:
82.
(e) "Employee" includes any individual employed by an em-
ployer but shall not include:
(1) Any individual employed in agriculture;
(2) Any individual employed in domestic service in or about
a private home;
(3) Any individual employed in a bona fide executive, adminis-
trative, or professional capacity (as such terms are defined and
delimited by regulation of the Commissioner);
(4) Any individual engaged in the activities of an educational,
charitable, religious, or nonprofit organization where the employer-
employee relationship does not in fact exist and where the services
are rendered to such organizations gratuitously, and with no expec-
tation of gain;
