Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1968.

CHAPTER 489
(Senate Bill 15)

AN ACT to repeal and re-enact, with amendments, Section 91 (a) of
Article 66˝ of the Annotated Code of Maryland (1967 Supple-
ment), title "Motor Vehicles," subtitle "Administration—Regis-
tration—Titling," to require the State Department of Public Wel-
fare, upon request, to notify the Department of Motor Vehicles of
the names of persons receiving public assistance for blindness, to
authorize the re-examination of such persons and cancellation of
operator's licenses and to make such information not a public
record.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 91(a) of Article 66˝ of the Annotated Code of Mary-
land (1967 Supplement), title "Motor Vehicles," subtitle "Adminis-
tration—Registration—Titling," be and it is hereby repealed and
re-enacted, with amendments, to read as follows:

91.

(a) The Department shall examine every applicant for an oper-
ator's, motorcycle operator's or chauffeur's license, except as other-
wise provided in this article. Such examination shall be held in such
places as the Department may designate. It shall include a test of the
applicant's eyesight, ability to read and understand highway signs
regulating, warning, and directing traffic, knowledge of the traffic
laws of this State, and shall include an actual demonstration of ability
to exercise ordinary and reasonable control in the operation of a
motor vehicle, and such further physical and mental examination as
the Department finds necessary to determine the applicant's fitness
to operate a motor vehicle safely upon the highways. The Depart-
ment at regular intervals shall request the State Department of Public
Welfare for the name of each person receiving public assistance for
blindness, and the Department of Public Welfare shall furnish these
names promptly. The Department upon receipt of such information
and as soon as practicable shall arrange for a re-examination of each
such person and, if the person examined fails to meet the vision
examination standards prescribed by Section 91 of this Article, the
Department shall cancel any license or licenses to operate held by
such person. Information obtained by the Department from the De-
partment of Public Welfare under the provisions of the preceding
sentence is not a matter of public record, and the use of any list or
names obtained through such access to the records for commercial
or political purposes is prohibited.

Sec. 2. And be it further enacted. That this Act shall take effect
July 1, 1968.
