(c) Any person who shall act as a commercial hunting guide
for hire without a valid license shall be guilty of a misdemeanor and
upon conviction shall be fined not more than one hundred dollars
($100.00) or imprisoned for not more than thirty (30) days, or
both, in the discretion of the court.
Upland and Migratory Game Birds and Game Animals
132. Hunting regulations.
(a) Open seasons.—The open season for game birds and game
animals shall be set by regulations of the Game and Inland Fish
Commission under authority conferred upon it by Section 115 of this
article [within the prescribed dates listed below.] The Game and
Inland Fish Commission shall adopt and publish seasons on game
birds and game animals annually on or before April 25 of each year,
and antlerless deer seasons, if any, before November 1 of each year,
provided, however, that whenever the Game and Inland Fish Com-
mission, in the exercising of its powers and authority, restricts or
reduces the number of days normally allowed for the hunting, tak-
ing, capturing, killing, possession, sale, purchase, shipment, trans-
portation, carriage or export of any wild bird or wild animal because
of an emergency situation or condition, said Game and Inland Fish
Commission shall have the authority to extend the period afore-
mentioned beyond the days specified below so as to provide a com-
parable number of days in any given season for hunting, taking,
capturing, killing, possession, sale, purchase, shipment, transporta-
tion, carriage or export of any wild bird or wild animal. The seasons
for wild ducks, geese, brant, railbirds, woodcock, doves and jack-
snipe shall be set annually and published each year in order that they
may, in the discretion of the Commission, conform to the federal
migratory bird regulations adopted annually by the Secretary of the
Interior.
