301. Definitions.
For the purposes of this subtitle:
(a) Community College. A community college is defined as an
institution of higher education, offering the equivalent of freshman
and sophomore years of college work and at least one two-year pro-
gram of post high school education and performing one or [more]
both of the following functions:
(1) Offering terminal, vocational, technical and semi-profes-
sional programs; or
(2) Offering terminal non-technical programs, [or (3) offering
the equivalent of freshman and sophomore years of college work.]

(a) Except for regional community colleges, the county super-
intendent of schools (and in Baltimore City the superintendent
of public instruction) shall serve as secretary and treasurer to the
board of trustees. The president of the community college shall at-
tend all meetings of the board, except those involving his personal
position as president. [The] Except for regional community col-
leges, the board of trustees, the superintendent, and the president
of the community colleges are charged with the preparation of the
annual budget, its presentation to the county commissioners, county
council, or the board of estimates of Baltimore City, and the receipt
and expenditures of budgeted funds under an adequate accounting
system, subject to review by the auditor of the county or of Baltimore
City, as the case may be. The board of trustees shall be styled
"The Board of trustees of ........................................ community (or
junior) college" and it may adopt a corporate seal. [The] Except for
Regional Community Colleges, the chairman of the board of educa-
tion or the board of school commissioners is the chairman of the
board of trustees.
(a-1) In the event that a new local board of trustees is created
pursuant to Section 304B of this article, then the provisions of
subsection (a) of this Section 802 shall be inapplicable with respect
to the county superintendent of schools (or superintendent of public
instruction). The president of the local community college or the
president of one of the local community colleges shall be selected
by the board or regional board to serve as secretary-treasurer of the
board.

The mayor and city council of Baltimore and the county commis-
sioners or county council of any county for which a community col-
lege or regional community college is established [by the board of
education or board of school commissioners] under this subtitle
have the right and power to appropriate funds to meet the cost of
establishment, current expenses, purchase of land, construction of
capital improvements, and the maintenance thereof. In addition, the
county commissioners or county council [or] of any county and
the mayor and city council of Baltimore City have the power to
borrow funds for the purchase of land and the construction of capital
improvements for said purposes upon such terms and conditions
