3. SMALL BUSINESS WITH NOT MORE THAN THREE
(3) PERSONS ON ANY ONE SHIFT WITH THE EXCEP-
TION OF PERSONS OR RETAILERS ENGAGED IN THE
SALE OF MOTOR VEHICLES.

(D)    NOTHING IN THIS SECTION IS APPLICABLE TO
ANY PERSON WHO BY REASON OF HIS RELIGIOUS CON-
VICTION OBSERVES A DAY OTHER THAN SUNDAY AS HIS
DAY OF REST AND ACTUALLY REFRAINS FROM LABOR
OR SECULAR BUSINESS ON THAT DAY, AND WHOSE ES-
TABLISHMENT IS CLOSED FOR BUSINESS ON THAT DAY.
THE TERM "A DAY OTHER THAN SUNDAY" AS USED
HEREIN SHALL MEAN ANY CONSECUTIVE TWENTY-
FOUR HOUR PERIOD.

(E)    NOTWITHSTANDING ANY PROVISION OF THIS SEC-
TION, ANY ESTABLISHMENT WHICH OFFERS SERVICE
AS ITS PRIMARY BUSINESS IS ALLOWED TO OPERATE
ON SUNDAY.

(F)    INDUSTRIES WHERE CONTINUOUS PROCESSING OR
MANUFACTURING IS REQUIRED BY THE VERY NATURE
OF THE PROCESS INVOLVED ARE ALLOWED TO OPER-
ATE ON SUNDAY.

(G)    ALL RECREATIONAL ACTIVITIES, SPORTS, AND
AMUSEMENTS ARE PERMITTED ON SUNDAY.

(H) NOTHING IN THIS SECTION SHALL BE DEEMED
OR CONSTRUED TO AMEND OTHER PROVISIONS OF LAW
WITH REFERENCE TO THE PROHIBITION OF WORK,
SPORT, BUSINESS, ALCOHOLIC BEVERAGE SALES, OR THE
SERVICE OF PROCESS ON SUNDAY.

(I) THE STATE'S ATTORNEY OF PRINCE GEORGE'S
COUNTY MAY PETITION THE CIRCUIT COURT TO EN-
JOIN ANY VIOLATION OF THIS SECTION.

(J) ANY PERSON, FIRM OR CORPORATION VIOLATING
THE PROVISIONS OF THIS SECTION IS GUILTY OF A
MISDEMEANOR AND, UPON CONVICTION, IS SUBJECT TO
THE FOLLOWING PENALTIES. THE FIRST CONVICTION
IS PUNISHED BY A FINE NOT TO EXCEED ONE THOU-
SAND DOLLARS ($1,000), A SECOND CONVICTION IS PUN-
ISHED BY A FINE NOT TO EXCEED TWO THOUSAND
DOLLARS ($2,000), AND FOR A THIRD OR SUBSEQUENT
CONVICTION BY A FINE NOT TO EXCEED TWO THOU-
SAND ($2,000), FOR EACH EMPLOYEE CAUSED, DIRECTED,
PERMITTED OR AUTHORIZED TO WORK IN VIOLATION OF
THIS SECTION. NOTHING CONTAINED HEREIN SHALL
BE CONSTRUED TO PERMIT ANY FINE UPON ANY EM-
PLOYEE OR AGENT WHO HAS BEEN CAUSED OR DI-
RECTED BY HIS EMPLOYER TO VIOLATE THE PROVI-
SIONS OF THIS SECTION.

Sec. 2. And be it further enacted, That this Act shall take effect

July 1, 1968.

SEC. 2. AND BE IT FURTHER ENACTED, THAT IF
ANY PART OR PARTS OF THIS ACT ARE DECLARED BY
A COURT OF COMPETENT JURISDICTION TO BE INVALID
