CHAPTER 404
(House Bill 1331)

AN ACT to add new Section 135F to the Code of Public Local Laws
of Worcester County (1961 Edition, being Article 24 of the Code
of Public Local Laws of Maryland), title "Worcester County", sub-
title "County Commissioners", to follow immediately after Section
135E thereof, as added by Chapter 31 of the Acts of 1966; to
authorize the County Commissioners of Worcester County to regu-
late the operation of roadside stands along public roads and high-
ways in Worcester County, with certain exceptions, and providing
penalties for violations.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 135F be and it is hereby added to the Code of
Public Local Laws of Worcester County (1961 Edition, being Article
24 of the Code of Public Local Laws of Maryland), title "Worcester
County", subtitle "County Commissioners", to follow immediately
after Section 135E thereof, as added, by Chapter 31 of the Acts of
1966, and to read as follows:

135F.

The County Commissioners of Worcester County are authorized,
by resolution or ordinance, to adopt rules and, regulations to restrict,
limit or prohibit the operation of any roadside stand, or stands, by
any individual, firm or corporation, who might offer for sale, or intend
to offer for sale, any farm produce, fruits, vegetables, or any other
merchandise of any kind, from any motor vehicle, or any other tem-
porary facility, on or along any public road or public highway or
portion thereof in said County. Provided, however, this act shall
not apply to any farmer who may wish to offer such produce or mer-
chandise for sale on land owned by him or to which he may hold a
valid rental or lease agreement, nor shall it apply to any individual,
firm or corporation, on land which he may own, or hold a valid rental
or lease agreement and licensed to conduct such business in accord-
ance with the provisions of any other existing public local law of
Worcester County or the general laws of the State of Maryland.

Any person violating any resolution or ordinance of the County
Commissioners of Worcester County, or any rule or regulation they
may adopt in connection therewith, relating to the operation of a
roadside stand on or along any public highway in said county, shall
be guilty of a misdemeanor and upon conviction thereof, shall be
fined not less than $10.00, nor more than $100.00.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1968.
