(h) A person who is intoxicated and who is not conducting him-
self in a manner that causes a public disturbance nor directly en-
dangers the safety of another person or of property may be taken
into protective custody by law enforcement officers or other author-
ized personnel and taken or sent to his home, to a private health
facility, or to a public health facility for detoxification and appro-
priate treatment;

(i) A chronic alcoholic shall be treated as a sick person and pro-
vided adequate and appropriate medical, psychiatric, and other
humane rehabilitative treatment services for his illness. All public
officials in the State shall take cognizance of this legislative policy
and this subtitle shall be construed in a manner consistent therewith.

103. Definitions.

(a)  The term "Department", as used in this subtitle, means the
State Department of Mental Hygiene.

(b)  The term "chronic alcoholic" means any person who chron-
ically and habitually uses alcoholic beverages (1) to the extent that
it injures his health or substantially interferes with his social
or economic functioning, or (2) to the extent that he has lost the
power of self-control with respect to the use of such beverages.

DISORDERLY INTOXICATION
201.

(a)  No person shall be intoxicated and endanger the safety of
another person or property.

(b)  No person shall be intoxicated or drink any alcoholic beverage
in a public place and cause a public disturbance.

(c)  Any person violating the prohibitions of this section is guilty
of a misdemeanor and upon conviction shall be punished by a fine of
not more than $100.00 or by imprisonment of not more than 90 days,
or both.

(d)  No county, municipality or other political subdivision of this
State shall adopt ordinances or resolutions identical to or supple-
menting this section, and any existing ordinance, resolution, or other
legislation inconsistent with this section is hereby repealed.

PREVENTION OF ALCOHOLISM AND REHABILITATION

OF ALCOHOLICS

301. Division of Alcoholism Control.

(a)  There is established within the Department a Division of
Alcoholism Control under a qualified program administrator who
shall be a licensed medical doctor.

(b)  It is the duty and function of the Division of Alcoholism Con-
trol to:

(1) Serve as a clearinghouse for information relating to alcoholism;

(2)  Develop, encourage, and foster statewide, regional, and local
plans and programs in the field of alcoholism;
