CHAPTER 108
(Senate Bill 476)

AN ACT to provide that at the general or congressional election in
Howard County in November 1968, there shall also be a primary-
election for selecting candidates for election to the County Council
and for County Executive of Howard County, in conjunction with
the vote on a proposed new charter under Article 11A of the Con-
stitution, and relating generally to the requirements and details
for this primary election.

Section 1. Be it enacted by the General Assembly of Maryland,
That at the general or congressional election to be held in Howard
County in the month of November, 1968, at which time there will
be submitted to the voters of Howard County a proposed new charter
under Article 11A of the Constitution of Maryland, there shall also
be a primary election for selecting candidates for election to the
County Council and for County Executive of Howard County. This
primary election shall be held and conducted in general conformity
with the statutes regulating elections in Howard County, except that
the final day for filing for nomination in the primary election shall
be the Tuesday which is five weeks or thirty-five days prior to the
day of the general or congressional election. The Board of County
Commissioners and the Board of Supervisors of Elections of Howard
County shall do such things as are necessary and proper under the
election laws to conduct the primary election as herein required.

A vote cast against the adoption of the charter shall not be held
to bar the voter from expressing his choice in the primary election.

If a majority of the votes cast on the question of adoption of the
charter are cast against adoption, the results of the primary election
shall be void and of no further effect. If a majority of the votes cast
on the question of adoption of the charter are cast for adoption, the
several persons nominated in the primary election shall be certified
as the candidates for County Council and for County Executive of
Howard County at the general election to be held thereafter.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1968.

CHAPTER 109
(Senate Bill 477)

AN ACT to repeal and re-enact, with amendments, Section 56 of
Article 77 of the Annotated Code of Maryland (1965 Replacement
Volume), title "Public Education," subtitle "Chapter 5. County
Board of Education," providing that in Frederick County the title
to grounds, sites and buildings no longer needed for school purposes
shall vest in the County Commissioners of Frederick County and
may be sold, leased or otherwise disposed of (except by gift) by
the Commissioners.
