AN ACT to add a new Section 26 to Article 36 of the Annotated
Code of Maryland (1965 Replacement Volume), title "Fees of
Officers," subtitle "Sheriffs," to follow immediately after Section
25, to increase the fees of the Sheriff in Prince George's County
for the several services and duties he performs.
SECTION 1. Be it enacted by the General Assembly of Maryland,
That a new Section 26 is hereby added to Article 36 of the Annotated
Code of Maryland (1965 Replacement Volume), title "Fees of Offi-
cers," subtitle "Sheriffs," to follow immediately after Section 25,
and to read as follows:
26.
(a) Notwithstanding any other provision of this article the Sheriff
for Prince George's County shall charge and collect these fees:
(1) For any action or service which involves only the serving
of a paper and is not an act of execution or attachment, a fee of
$5.00.
(2) For any action or service which includes an act of execution
or attachment, involving a seizure or a taking into custody of any
property, real or personal, or of any person, a fee of $10.00. If
the Sheriff incurs any actual expenses for the purpose of conserv-
ing and protecting property seized, he shall be entitled to reim-
bursement for such expenditures.
(b) If the act of execution or attachment leads into an actual
sale of property, the several sheriffs may charge and collect an addi-
tional poundage fee, computed on the sale price of the property
sold, as follows:
(1) For personal property: 3% of the first $5,000.00 of sale
price, plus 2% of the second $5,000.00 of sale price, plus 1% of
any portion of the sale price in excess of $10,000.00. Under this
paragraph in any event, the minimum fee is $3.00 the maximum fee
is $500.00.
(2) For real property: 1½% of the first $5,000.00 of sale price,
plus 1% of the second $5,000.00 of sale price, plus ½ of 1% of any
portion of the sale price in excess of $10,000.00. Under this para-
graph in any event, the minimum fee is $1.50 and the maximum
fee is $250.00.
Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1968.
