(B) AN INSPECTION TAX OF ONE CENT (1¢) PER
BUSHEL IS HEREBY LEVIED UPON ALL OYSTERS CAUGHT
OUTSIDE THE LIMITS OF THE STATE OF MARYLAND
AND IMPORTED INTO THE STATE; SAID TAX SHALL BE
PAID BY BUYER AT THE POINT WHERE SUCH OYSTERS
ARE TO BE NO FURTHER SHIPPED IN BULK, AND SAID
TAX SHALL BE PAID WEEKLY TO THE DEPARTMENT
OF CHESAPEAKE BAY AFFAIRS.

(c)  A separate permit shall be obtained for shipping each cargo,
truckload, or other consignment of oysters in the shell out of this
State; and an inspection tax of two TEN cents (2¢) (10¢) per bushel
is hereby levied upon all merchantable oysters shipped in the shell to
any place outside the State of Maryland [;] , which tax shall be paid
by the shipper at the time of issuance of the permit required by this
subsection,
[and each cargo, truckload, or other consignment of such
oysters shall be inspected by the Department of Tidewater Fisheries
and said tax shall be due and payable to said Department by the
person shipping or carrying such oysters out of the State of Mary-
land.] The tax imposed by this subsection is levied in addition to
any or all other taxes imposed on oysters.

(d)    A severance tax of twenty-five TWENTY cents (25¢) (20¢)
per bushel is hereby levied upon all oysters caught or taken within the
limits of the natural oyster bars of the State of Maryland exclusive of
the Potomac River. The tax shall be collected from the catcher by the
first buyer or receiver of the oysters at the time the oysters are pur-
chased or received from the catcher, and shall be paid by the buyer or
receiver weekly to the Department of Chesapeake Bay Affairs for de-
posit to the credit of the Fisheries Research and Development Fund.
Nothing in this section shall be construed to prevent any person
licensed to catch oysters in Maryland from selling his oysters in the
shell directly to a consumer in Maryland. Unless, however, that con-
sumer is a licensed buyer of oysters, the seller of oysters shall assume
the obligation placed by this subsection upon the first buyer of the
oysters to remit the tax to the Department of Chesapeake Bay Affairs.
ANY FUNDS COLLECTED UNDER SECTION 711 AND CRED-
ITED TO THE FISHERIES RESEARCH AND DEVELOP-
MENT FUND SHALL BE USED FOR THE REPLETION OF
THE NATURAL OYSTER BARS OF THIS STATE AND FOR
NO OTHER PURPOSES.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1968.
