(b) What bait may be sold or kept in possession; inspection of
bait boxes.—The bait sold shall be only minnows, chubs measuring
less than six inches in length, and killifishes and must be procured
from the waters of the Potomac River only. The live-bait dealer
shall not possess more than 750 bait-fish of all types allowed at one
time.
The bait boxes of the live-bait dealer shall be open for inspection
by the [Wardens] Wildlife Officers at all reasonable times.
213. Live bait dealer's license—Frederick and Washington Counties.
(a) License required in Frederick and Washington counties.—
Any person desiring to sell live bait in Frederick and Washington
counties shall make application to the Clerk of the Circuit Court for
a live bait dealer's license, the cost of which shall be ten dollars
($10.00) AND FIFTY CENTS ($10.50) a year, in Frederick [County
and Five dollars a year ($5.00) in] and Washington counties.

of [Game and Inland Fish Commission] may prescribe and shall
contain an affidavit signed by the applicant that he is a resident of
the county. The Clerk of the Circuit Court or his agent, is authorized
to issue to the applicant a license to be supplied to said clerk by the
Director. The Clerk of the Circuit Court shall retain as compensa-
tion for issuing the above licenses the sum of twenty five-cents
(25˘) FIFTY CENTS (50˘) and shall on the first day of July,
1957; and on the first day of each and every month thereafter trans-
mit to the Department of Game and Inland Fish [Commission] of
the State all monies received by him for licenses, and such funds
shall be accounted for by the said [Commission] Department to the
[Comptroller] Treasurer of the State.

216. Privately owned artificial ponds or lakes.
(a) Permit to establish and stock.—The Department of Game
and Inland Fish [Commission] may issue permits authorizing the
establishment and operation of artificial or man-made ponds or lakes
owned, leased or controlled by an individual, association or corpora-
tion, where fishing is permitted for payment of a fee, and in which
all fish stocked are artificially propagated by commercial hatcheries,
or purchased from persons licensed to sell fish, when in the judgment
of the [Commission] Department such lakes or ponds will not con-
flict with any reasonable prior public interest. The fee for such
permit shall be Twenty-five Dollars ($25.00) per annum and said
license shall expire on the 31st day of December next following
date of issuance. The Commission shall govern and prescribe by
regulation the size of the area, the method of fishing, the open and
closed seasons, and the taking of fish with tags furnished by the
[Commission] Department at a reasonable fee, the releasing, posses-
