(c) At the hearing the accused shall have the right to appear
either personally or by counsel, or both, to produce witnesses and
evidence on his or her own behalf, and to cross-examine witnesses.
If the accused shall be found guilty of the charges, the Board may
refuse to issue a license to the applicant or may revoke or suspend
a license. A revoked or suspended license may be reinstated after
one year, in the discretion of the Board.
300.
This subtitle does not prohibit:
(a) The furnishing of nursing assistance in an emergency.
(b) The practice of nursing which is incidental to their pro-
gram of study by students enrolled in nursing education programs
approved by the Board.
(c) The practice by any legally qualified nurse of another state,
district or territory of the United States who is employed by the
United, States Government or any bureau, division or agency thereof,
while in the discharge of his or her official duties.
(d) The performance of selected acts of nursing as authorized in
Section 291 (d) of this article.
(e) Care of the ill, injured or infirm by a Christian Science
nurse, listed in the The Christian Science Journal, provided he or she
administers no medicines or drugs, internal or external.
301.
(a) It shall be a misdemeanor for any person to:
(1) Sell or fraudulently obtain or furnish any nursing diploma,
license, renewal or record, or aid or abet such activity.
(2) Practice nursing as defined by this subtitle under color of
any diploma, license, or record illegally or fraudulently obtained or
signed or issued unlawfully or under fraudulent representation.
(3) Practice professional nursing or practical nursing as defined
by this subtitle unless duly licensed to do so under the provisions of
this subtitle.
(4) Use in connection with his or her name the designation
"nurse" (except as authorized in Section 300(e) of this article) or any
other designation tending to imply that he or she is a licensed regis-
tered nurse or a licensed practical nurse unless duly licensed so to
practice under the provisions of this subtitle; provided, however,
that until June 1, 1969, nothing in this subtitle shall prevent un-
licensed persons from using the designation "nurse" or "practical
nurse."
(5) Practice professional nursing or practical nursing during the
time his or her license issued under the provisions of this subtitle
shall be lapsed, suspended or revoked.
(6) Otherwise violate any provisions of this subtitle.
(b) Any person convicted of violating this subtitle shall be
fined not less MORE than one hundred dollars for the first offense.
Each subsequent offense shall be punishable by a fine of NOT MORE
THAN five hundred dollars or by imprisonment of not more than six
months or by both such fine and imprisonment.
