CHAPTER 376
(House Bill 1117)

AN ACT to repeal and re-enact, with amendments, Sections 19
(d-2) (3) and 95A(a) of Article 2B of the Annotated Code of
Maryland (1966 Supplement), title "Alcoholic Beverages," subtitle
"Beer, Wine and Liquor Licenses" and "Hours and Days for Sale,"
to change certain provisions concerning Sunday sales of alcoholic
beverages by certain licensees in Carroll County.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 19(d-2) (3) and 95A(a) of Article 2B of the Annotated
Code of Maryland (1966 Supplement), title "Alcoholic Beverages,"
subtitle "Beer, Wine and Liquor Licenses" and "Hours and Days for
Sale," be and they are hereby repealed and re-enacted, with amend-
ments, to read as follows:

19.

(d-2) (3) Such a license may be issued in Carroll County to a
restaurant which meets the following requirements and conditions:
(i) Serves full-course meals at least twice daily; (ii) has a regular
seating capacity at tables (not including seats at bars or counters)
for fifty (50) or more persons; and (iii) is operated in facilities
which are valued for purposes of State and local assessment and
taxation at not less than twenty thousand dollars ($20,000). This
license in a restaurant does not permit sales for consumption any-
where except inside the building in which the meals are prepared and
served, but sales of beer only for consumption off the premises may
be made under this license on any day of the week [except Sunday.]

95A.

(a) In Carroll County, notwithstanding any other provisions in
this article, the following restrictions, limitations, and regulations
shall be in effect.

(a). Holders of "on sale" licenses authorized under this article
may sell, offer for sale, or dispense alcoholic beverages during the
hours of 8:00 A.M. and 1:00 A.M. and no other hours. Holders of
such licenses shall not sell, offer to sell or dispense any alcoholic
beverages on Sunday, except that when the holder of such a license
shall have been open for business on Saturday at midnight he may
remain open until 1:00 A.M. the Sunday immediately following and
except that holders of Class B and C beer, wine and liquor licenses
may reopen and may sell alcoholic beverages on Sundays between the
hours of [2:00] 1:00 P.M. and 1:00 A.M. the following Monday
but no sales upon such reopening on Sunday shall be made at bars or
counters. In all cases wherein a closing time is indicated in this
subsection no licensee shall permit the drinking of any alcoholic
beverage in or on his premises after fifteen (15) minutes following
the closing time indicated.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1967.
