148.

(a) The county board of education of each county shall appoint
during the month of May a superintendent of schools for a term of
four years, from the first day of [August] July next succeeding
his appointment, and he shall hold office until his successor qualifies.
No person shall be eligible for appointment to the office of county
superintendent of schools who does not hold from the State Superin-
tendent of Schools a certificate in administration and supervision as
provided for in Section 101 of this article, nor shall the appointment
of any person by the county board of education to the position of
county superintendent of schools be valid without the written ap-
proval of the State Superintendent of Schools; provided, however,
that if the State Superintendent of Schools shall not approve of
the proposed appointment of a person to the position of county super-
intendent of schools, he shall certify in writing to the county board
of education his reasons for such refusal to approve of the ap-
pointment of such person. Provided that all county superintendents
of schools holding office at the time when this section shall take
effect, shall continue to serve to the end of the term for which
they were originally appointed, and until their successors qualify,
unless removed, as hereinafter provided, and shall also be eligible
for reappointment.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1967.

(House Bill 918)

AN ACT to repeal and re-enact with amendments, Section 1 of
Article 89 of the Annotated Code of Maryland (1964 Replacement
Volume and 1966 Supplement), title "Department of Labor and
Industry," subtitle "In General," to remove restrictive require-
ments in conducting competitive examination for office of deputy
commissioner.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 1 of Article 89 of the Annotated Code of Maryland
(1964 Replacement Volume and 1966 Supplement), title "Depart-
ment of Labor and Industry," subtitle "In General," be and it is
hereby repealed and re-enacted, with amendments, to read as follows:

1.

The Department of Labor and Industry is hereby created. The
head of said Department shall be known as the Commissioner and
shall be appointed by the Governor for a term of four years, and until
his successor shall be appointed and shall have qualified, and shall
devote his entire time to the performance of the duties of his office.
Any vacancy shall be filled by the Governor for the unexpired term.
The term of the present Commissioner shall terminate on June 30,
1953. The Governor shall appoint to take office on July 1, 1953, a
