power to administer oaths to witnesses appearing before the Hearing
Examiner
OR BOARD; such oath to have all the qualities of an oath
taken before any judicial tribunal or officer and violations thereof to
be punishable as other perjuries are punishable.

(4) The Bearing Examiner OR BOARD shall render a written
recommendation at such time and in such manner and form as may be
required by the district council. Any application on which a public
hearing has been held either by the district council or a Hearing
Examiner
OR BOARD may be assigned or reassigned to an examiner,
which examiner must read and examine the evidence of record, or, in
the discretion of the district council, conduct a new hearing before
rendering a recommendation, as provided hereinabove.

(5) An application, as provided hereunder, may be decided
solely on the basis of the Hearing Examiner's
OR BOARD'S recom-
mendation; provided, however, that within ten (10) days after trans-
mittal of the Hearing Examiner's
OR BOARD'S written recommenda-
tion to the district council, any person or association haying appeared
and participated, in person or by counsel, at the hearing before the
Hearing Examiner
OR BOARD, may request the right to present oral
argument before the district council prior to its rendering a decision.
The district council may, in its discretion, grant or deny such request.

Sec. 2. And be it further enacted, That this Act shall take effect
Jure 1, 1967.

CHAPTER 248
(House Bill 434)

AN ACT to repeal and re-enact, with amendments, Section 142 of
Article 27 of the Annotated Code of Maryland (1966 Supplement),
title "Crimes and Punishments," subtitle "1. Crimes and Punish-
ments," subheading "False Pretenses, Bad Checks, etc.," changing
the monetary limit dividing the two degrees of the offense of
obtaining money or other things of value by bad checks or other
instruments or unauthorized credit cards or authorizations, in-
creasing the penalty AND JURISDICTION for the lesser degree
of such offense, and specifying the concurrent jurisdiction of trial
magistrates and judges of courts of limited jurisdiction over such
lesser degree.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 142 of Article 27 of the Annotated Code of Maryland
(1966 Supplement), title "Crimes and Punishments," subtitle "1.
Crimes and Punishments," subheading "False Pretenses, Bad Checks,
etc.," be and it is hereby repealed and re-enacted, with amendments,
to read as follows:

142.

Every person who, with intent to cheat and defraud another, shall
obtain money, credit, goods, services, release from any debt or
