gram accordingly, but only if such amendment can be accomplished
without causing the deletion or deferral of any project scheduled
or proposed for [Prince George's County] the other county. [The
County Council] A county governing body shall also have the au-
thority to MODIFY, DEFER OR veto, and direct that no construc-
tion be commenced on, any project which has been previously ap-
proved but not yet contracted for construction within three years
of its first approval by [the
Council] that county governing body
BY IT BUT NOT YET CONTRACTED FOR CONSTRUCTION
BY THE COMMISSION; PROVIDED, THAT IN THE EVENT
THAT AS A DIRECT RESULT OF THE COUNTY GOVERNING
BODY'S CHANGE IN AN EARLIER APPROVAL THE COMMIS-
SION BECOMES LEGALLY LIABLE TO THIRD PARTIES, THE
COUNTY GOVERNING BODY SHALL BE RESPONSIBLE FOR
ANY SUCH LIABILITY, AND THE SETTLEMENT OR RELEASE
OF CLAIMS FOR SUCH LIABILITIES, IF ANY, SHALL BE AC-
COMPLISHED BY THE COUNTY GOVERNING BODY UPON
SUCH BASIS AS IT MAY NEGOTIATE WITH THE CLAIMANT
OR BY ITS PAYMENT OF ANY FINAL JUDGMENT OF ANY
COURT AWARD, AND IT SHALL HAVE A RIGHT TO INTER-
VENE IN ANY SUCH COURT PROCEEDINGS PRIOR TO JUDG-
MENT AND TO INTERPOSE ANY AND ALL DEFENSES AVAIL-
ABLE TO IT OR THE COMMISSION; AND PROVIDED
FURTHER, THAT THE COUNTY GOVERNING BODY SHALL
BE RESPONSIBLE FOR REIMBURSING THE COMMISSION
FOR ANY EXPENDITURES MADE TO THIRD PARTIES FOR
SERVICES OR PROPERTY DIRECTLY ATTRIBUTABLE TO
THE COMMISSION'S IMPLEMENTATION OF ANY PROJECT
MODIFIED OR VETOED AND MADE OBSOLETE OR UNNECES-
SARY BY ANY SUCH CHANGE. THE COMMISSION'S RIGHT,
TITLE AND INTEREST IN ANY ITEMS FOR WHICH REIM-
BURSEMENT HAS BEEN MADE SHALL BE CONVEYED TO
THE COUNTY GOVERNING BODY.

[(d)] (e) Additional information. FOR PROJECTS AP-
PROVED BY A COUNTY GOVERNING BODY AFTER THE EF-
FECTIVE DATE OF THIS ACT A FINAL REPORT THEREON,
INCLUDING CONSTRUCTION COST FIGURES, SHALL BE
SUBMITTED BY THE COMMISSION TO THE COUNTY GOV-
ERNING BODY AFTER THE PROJECT HAS BEEN COM-
PLETED. At the time of transmitting the five year program [, and
at the time of transmitting each annual revision to the County Council
for Montgomery County,] to the county governing bodies the Com-
mission shall send [the Council] them a status report with respect
to all [previously approved] projects approved by county governing
bodies
which have not been completed as of the date of the trans-
mitted program. The Commission shall identify the project, give the
date of approval or the dates of approval if it has been approved on
more than one occasion, and indicate the current status thereof and
an estimate of the date of completion of construction , AND IN-
DICATE WHETHER ANY MATERIAL CHANGES HAVE BEEN
MADE IN THE PROJECT SINCE ITS LAST DATE OF AP-
PROVAL.

[(e)] (f) Extension beyond approved area. The Sanitary Com-
mission shall not extend or approve construction of sewer of any
size or capacity to serve properties in either Montgomery County or
