ment. It is the intention of the General Assembly that the State
assume from the local jurisdictions of the State all monitoring duties.
The Division shall as soon as feasible prepare and submit to the
Board for approval standards and procedures to be followed when-
ever pollution of the air reaches an emergency condition. Whenever
such a condition is found to exist by the Board, the standards there-
for shall become effective for such time as the Board determines the
emergency to exist. During such period the regulations effective
therein shall be enforced to the fullest extent of the State's power.

The Division shall submit to the Board for approval rules and
regulations establishing the procedure for hearings for violations
of any of the standards adopted pursuant to this subtitle. The hear-
ings and any appeals therefrom shall be controlled by the applicable
provisions of the Administrative Procedure Act.
The Attorney General of Maryland shall be the legal advisor for
the Division, shall enforce compliance with the requirements of this
subtitle through any appropriate legal remedies and shall prosecute
violations of Section 699 of this Article.
The Division is authorised to obtain for the use of the State such
federal or other funds as may be available from time to time for
purposes within the scope of this subtitle.

Violation of any standards or rules and regulations adopted under
this subtitle shall subject the offender to fine not to exceed five
thousand dollars ($5,000) for each violation. Each day on which a
violation occurs shall constitute a separate violation under this
section.

AIR QUALITY CONTROL
(A) IT IS HEREBY DECLARED TO BE THE POLICY OF
THE STATE OF MARYLAND TO MAINTAIN THAT DEGREE
OF PURITY OF THE AIR RESOURCES OF THE STATE WHICH
WILL PROTECT THE HEALTH, GENERAL WELFARE AND
PROPERTY OF THE PEOPLE OF THE STATE.
(B) FOR THIS PURPOSE THE STATE DEPARTMENT OF
HEALTH SHALL ASSUME RESPONSIBILITY FOR THE JURIS-
DICTION OVER EMISSIONS INTO THE AIR AND AMBIENT
AIR QUALITY.

FOR THE PURPOSES OF THIS SUBTITLE:
(A) THE TERM "AIR POLLUTION" SHALL MEAN THE
PRESENCE IN THE OUTDOOR ATMOSPHERE OF SUB-
STANCES IN QUANTITIES, HAVING CHARACTERISTICS
