ing that nothing herein contained shall be taken as restricting any
control which the State Board of Health of Maryland and the State
Department of Water Resources are empowered to exercise within
the county.

(b) The provisions of this subtitle are severable, and it is the in-
tention to confer the whole or any part of the powers herein pro-
vided for, and if any of the provisions of this subtitle shall be held un-
constitutional by any court of competent jurisdiction, the decision
of such court shall not affect or impair any of the remaining provi-
sions of this subtitle. It is hereby declared to be the legislative in-
tent that this subtitle would have been adopted had such unconstitu-
tional provision not been included therein.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1967.

CHAPTER 755
(House Bill 1055)

AN ACT to repeal and re-enact, with amendments, Section 113 of the
Code of Public Local Laws of Kent County (1959 Edition, being
Article 15 of the Code of Public Local Laws of Maryland), title
"Kent County," subtitle "County Commissioners," to increase the
salary and expense allowance for the County Commissioners of
Kent County.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 113 of the Code of Public Local Laws of Kent County
(1959 Edition, being Article 15 of the Code of Public Local Laws of
Maryland), title "Kent County," subtitle "County Commissioners,"
be and it is hereby repealed and re-enacted, with amendments, to
read as follows:

113.

Three County Commissioners of Kent County shall be elected at
the General Election to be held on the Tuesday after the first Monday
in November, 1946, and every fourth year thereafter for a term of
four (4) years. They shall have all the powers, and perform all the
duties that are now or hereafter may be imposed on them by law, and
they shall each receive, as compensation, the sum A SALARY of
[nine] nineteen hundred dollars ($1,900.) THREE THOUSAND
SIX HUNDRED DOLLARS ($3,600.) per annum and [effective
January 1, 1959, eight hundred dollars ($800 00)]
until January 1,
1971
AN ALLOWA.NCE OF one thousand dollars ($1,000.) per year
for expenses and mileage at the rate of five cents (5¢) per mile while
attending to their official duties, but not to exceed One Hundred and
Twenty five- Dollars per year for any Commissioner INCURRED IN
PERFORMANCE OF THEIR DUTIES AS COUNTY COMMIS-
SIONERS.
