(e)    Provided that the retirement allowance used in calculating
the supplementary payment shall be the total benefits provided in
Section 31 of this article except that it shall not be based on any
optional benefit chosen by the beneficiary or member, and

(f)    Provided that such beneficiary or member, excepting any
person who may retire for reasons of disability, [is not eligible to
receive benefits from the federal old age and survivors' insurance
system; but this subsection shall not be construed to affect or bar
any person's right to receive supplementary payments under this
article or any other laws of this State, if such person was receiving
such payments prior to June 1, 1958.] who receives benefits from
the federal old age and survivors' insurance system shall have any
supplemental payment for which said beneficiary is eligible, under
this subtitle, reduced by an amount equal to the benefit received
from the federal old age and survivors' system. Such reduction,
however, shall not be greater than the total amount of the supple-
mental payment for which said beneficiary is eligible.

Sec. 4 And be it further enacted, That this Article shall take effect
July 1, 1967.

CHAPTER 712
(House Bill 24)

AN ACT to repeal and re-enact, with amendments, Section 11(14)
of Article 73B of the Annotated Code of Maryland (1957 Edition
and 1966 Supplement), title "Pensions," subtitle "In General," to
provide that a retired State employee may accept employment with
the State if he notifies the Board of Trustees of the Employees
Retirement System and that the compensation for such
employ-
ment plus his retirement benefits cannot exceed the amount of

the average final compensation upon which retirement allowance
was based TO REPEAL AND RE-ENACT, WITH AMEND-
MENTS, SECTION 113 (9) OF ARTICLE 77 OF THE SAID
CODE, (1965 REPLACEMENT VOLUME), TITLE "PUBLIC
EDUCATION," SUBTITLE "CHAPTER 8. TEACHERS' CER-
TIFICATES, SALARIES AND PENSIONS," SUBHEADING
"TEACHERS' RETIREMENT SYSTEM," TO ADD NEW SEC-
TION 53(13) TO ARTICLE 88B OF THE SAID CODE (1966
SUPPLEMENT), TITLE "STATE POLICE" SUB-TITLE
"STATE POLICE RETIREMENT SYSTEM," TO FOLLOW
IMMEDIATELY AFTER SECTION 53 (12) THEREOF, TO
CHANGE THE LIMITATIONS ON EMPLOYMENT WITH THE
STATE OF MARYLAND OR THE GENERAL ASSEMBLY BY
RETIRED MEMBERS OF THE STATE EMPLOYEES',
TEACHERS' AND STATE POLICE RETIREMENT SYSTEMS,
AND TO PROVIDE FOR THE EFFECT OF SUCH EMPLOY-
MENT AND COMPENSATION THEREFOR ON THE RETIRE-
MENT ALLOWANCE PAID TO SUCH RETIRED STATE
EMPLOYEES, TEACHERS AND STATE POLICE.
