Sec. 3. And be it further enacted, That if any provision of this
Act or the application thereof to any person or circumstance is held
invalid for any reason, such invalidity shall not affect the other
provisions or any other application of this Act which can be given
effect without the invalid provision or application, and to this end,
all the provisions of this Act are hereby declared to be severable.

Sec. 4. And be it further enacted, That this Act shall take effect
June 1, 1967.

AN ACT to repeal Section 704 of Article 27 of the Annotated Code
of Maryland (1966 Supplement), title "Crimes and Punishments",
subtitle "Places of Reformation and Punishment", subheading
"Department of Correction", sub-subheading "Miscellaneous";
and to enact new Section 704 in lieu thereof, to stand in the place
of the section so repealed and to be under the new subheading
"Department of Jail Programming", under the subtitle "Places of
Reformation and Punishment", to create the new State Depart-
ment of Jail Programming, to provide for its Director, his ap
-

pointment, tenure, powers and duties and for the powers and

duties of the Department with respect to jails in the State. "JAIL
PROGRAMMING AND INSPECTION", UNDER THE SUB-
HEADING "DEPARTMENT OF CORRECTION", TO CREATE
THE POSITION OF JAIL PROGRAMMING AND INSPECTION
OFFICER IN THE DEPARTMENT OF CORRECTION, TO
PROVIDE FOR HIS POWERS AND DUTIES WITH RESPECT
TO JAILS AND PLACES OF DETENTION IN THE POLITI-
CAL SUBDIVISIONS OF THE STATE, TO AUTHORIZE ES-
TABLISHMENT OF MINIMUM STANDARDS FOR JAILS AND
PLACES OF DETENTION AND TO PROVIDE FOR FAILURE
TO MEET SUCH STANDARDS AND TO AUTHORIZE THE
STATE TO CONTRIBUTE A PORTION OF THE FUNDS FOR
THE CONSTRUCTION OR RECONSTRUCTION OF JAILS
AND PLACES OF DETENTION IN THE STATE.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 704 of Article 27 of the Annotated Code of Maryland
(1966 Supplement), title "Crimes and Punishments", subtitle "Places
of Reformation and Punishment", subheading "Department of Cor-
rection", sub-subheading "Miscellaneous", be and it is hereby re-
pealed, and that new Section 704 BE AND IT is hereby enacted in
lieu thereof to stand in the place of the section so repealed and to be
under the new subheading "Department of Jail Programming", under
the subtitle "Places of Reformation and Punishment", and to read as
