(b) The provisions of Sections 259U-259AD, inclusive, of this
sub-title are severable, and if any of such provisions shall be held
unconstitutional by any court of competent jurisdiction, the decision
of such court shall not affect or impair any of the remaining
provisions.
Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1967.

AN ACT to repeal Sections 412 through 430, inclusive, of Article 81
of the Annotated Code of Maryland (1965 Replacement Volume),
title "Revenue and Taxes," subtitle "Road Tax on Motor Carriers,"
and Sections 465 through 477 of Article 81 of the Annotated Code
of Maryland (1965 Replacement Volume), title "Revenue and
Taxes," subtitle "Compact on Taxation of Motor Fuels Consumed
by Interstate Buses," and to enact new Sections 412 through 429,
inclusive, in lieu thereof, to stand in the place of the sections
repealed, to provide for a payment of a road tax by commercial
carriers within this State and to provide generally for the regu-
lations, definitions, enforcement, credits and audits of this sub-
title by the Comptroller of the Treasury.
Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 412 through 430, inclusive, of Article 81 of the An-
notated Code of Maryland (1965 Replacement Volume), title "Reve-
nue and Taxes," subtitle "Road Tax on Motor Carriers," and Sec-
tions 465 through 477 of Article 81 of the Annotated Code of Mary-
land (1965 Replacement Volume), title "Revenue and Taxes," sub-
title "Compact on Taxation of Motor Fuels Consumed by Interstate
Buses," be and they are hereby repealed, and that new Sections 412
through 429, inclusive, be and they are hereby enacted in lieu thereof,
to stand in the place of the sections repealed, and to read as follows:
412. DEFINITIONS
(a) The term "Motor Fuel" means any liquid, regardless of its
composition or properties, used to propel a motor vehicle.
(b) The term "Commercial motor vehicle" means a passenger
vehicle that has seats for more than nine passengers in addition to
the driver, or any road tractor, or any truck tractor or any truck
having more than two axles; which commercial motor vehicle is
propelled by motor fuel.
(c) The term "Motor Carrier" means any person who operates
or causes to be operated any commercial motor vehicle on any high-
way in this state.
(d) The term "Highway" means the entire width between the
boundary lines of every way publicly maintained when any part
