Section 1. Be it enacted by the General Assembly of Maryland,
That Section 40 (p) of Article 10 of the Annotated Code of Maryland
(1957 Edition and 1966 Supplement), title "Attorneys at Law and
Attorneys in Fact," subtitle "State's Attorney," be and it is hereby
repealed and re-enacted, with amendments to read as follows:
40.
(p) In Montgomery County, (1) the State's Attorney's salary is
twenty thousand dollars ($20,000) per annum. The State's Attorney
shall devote his full time and attention to the duties of his office
as State's Attorney and shall not engage in the private practice
of law at any time in any jurisdiction during his tenure of office.
(2) The State's Attorney may appoint a deputy State's at-
torney and [five] six assistant State's attorneys. The deputy
State's attorney's salary shall be [not less than thirteen thousand
dollars ($13,000) nor more than fifteen thousand dollars ($15,000)
to be determined by the County Council in its discretion] deter-
mined by the State's Attorney in his discretion, but shall not exceed
seventeen thousand five hundred dollars ($17,500.00). The assist-
ant State's attorneys' salaries shall be [not less than eight thousand
dollars ($8,000) each nor more than ten thousand dollars ($10,000)
each to be determined by the County Council in its discretion]
determined by the State's Attorney in his discretion, but none
shall exceed fourteen thousand dollars ($14,000.00). The deputy
State's attorney and the [five] six assistant State's attorneys shall
devote their full time and attention to the duties of their offices and
shall not engage in the private practice of law at any time in any
jurisdiction during their tenure of office.
(3) The State's Attorney, the deputy State's attorney and the
assistant State's attorneys, or any of them, shall present cases to
the grand jury and perform such other acts and duties in relation
to the grand jury as are necessary and proper. The salaries of the
State's Attorney and of the deputy and assistant State's attorneys
include such services as any of them perform before or in behalf
of the judges of the Circuit Court, justices of the peace or judges
of the People's Court of the county in preliminary hearings or trials
in criminal cases.
(4) The State's Attorney may appoint [four] five clerks at
such salary as [may be fixed by the County Council] he may fix
provided that no such salary shall exceed eight thousand dollars
($8,000.00).
(5) The State's Attorney may appoint a special investigator,
who shall be directly under the supervision of the State's Attorney
and perform such duties as the State's Attorney may designate
from time to time. The special investigator's salary shall be [not
less than seven thousand dollars ($7,000) nor more than nine thou-
sand dollars ($9,000) to be determined by the County Council in
its discretion] determined by the State's Attorney in his discre-
tion, but shall not exceed ten thousand dollars ($10,000.00). The
special investigator shall devote his full time and attention to his
duties as special investigator and shall not engage in other employ-
ment during the time he is employed as special investigator [with-
out the specific written permission of the State's Attorney].
