payment of all court costs out of the assets of the insurer prior to
any distribution to creditors or termination of rehabilitation. In
all such cases the costs, including those contained in paragraph one
hereof, shall be charged in the Commissioner's accounts to the court
or be paid by the insurer as a condition of termination of the pro-
ceedings, as the case may be.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1967.

CHAPTER 453
(Senate Bill 247)

AN ACT to add a new Section 110(5a) to Article 77 of the Annotated
Code of Maryland (1965 Replacement Volume), title "Public Edu-
cation," subtitle "Chapter 8. Teachers' Certificates, Salaries and
Pensions," subheading "Teachers' Retirement System," to follow
immediately after Section 110(5) thereof, amending the laws con-
cerning the Teachers' Retirement System in order to permit the
crediting of membership service, after the payment of certain
accumulated contributions, for certain services as a teacher in a
private school performing public school functions, and relating
generally to the terms and conditions for such membership service
credit.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 110(5a) be and it is hereby added to Article 77
of the Annotated Code of Maryland (1965 Replacement Volume),
title "Public Education," subtitle "Chapter 8. Teachers' Certificates,
Salaries and Pensions," subheading "Teachers' Retirement System,"
to follow immediately after Section 110(5) thereof, and to read as
follows:

110.

(5a) Any person who has served as a teacher in any private
school in Maryland which school has by reason of accepting and
educating without charge, children eligible for but unable to attend
public school by reason of the absence of public school facilities in
the community, and who is presently serving as a public school
teacher in Maryland shall be given membership service for the period
spent in such private school prior to the year 1940. To be eligible
to receive credit for this membership service, the person shall pay
to the Retirement System the full amount of what would have been
his accumulated contributions therein had he in fact been a member
of the Retirement System during the period spent in the private
school.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1967.
