to provide for an increase in the membership of the Sanitary
Commission for Garrett County and the methods for appointment.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 649(a) (1) of Article 43 of the Annotated Code of
Maryland (1965 Replacement Volume), title "Health," subtitle
"Sanitary Districts," be and it is hereby repealed and re-enacted,
with amendments, to read as follows:
649.
(a) The powers of each district shall be exercised by a govern-
ing body (herein called the "commission") composed as follows:
(1) If the district is incorporated by one county, except in Al-
legany [County,] and Garrett Counties the commission shall be com-
posed of three citizens of such county, no one of whom shall hold
any other office of said county during his term of office on said com-
mission. The governing body of such county shall appoint the mem-
bers of the commission, whose terms of office shall commence on
the date of appointment, and one of whom shall serve for two years,
one for four years, and one for six years from the January first next
succeeding the date of incorporation, and thereafter the said gov-
erning body shall, at a meeting held not later than one month prior
to January first in each year in which a vacancy occurs, appoint as a
member of the commission a citizen of the county for which the
district is created, for a term of six years, to succeed the member
whose term expires on the January first next succeeding.
The Allegany County sanitary commission appointed pursuant to
the preceding paragraph shall be enlarged from three citizens of
such county to seven citizens of such county, no one of whom shall
hold any other office of said county during his term of office on said
commission. As of June first, 1963, the governing body of such
county shall appoint the four additional members of the commission
provided for herein, whose terms of office shall commence on the
date of appointment, and two of whom shall serve for six years,
one for four years and one for two years from the date of their
appointment. At the expiration of each of said terms, the county
governing body shall, at a meeting held not later than one month
prior to June first in each year in which a vacancy occurs, appoint
as a member of the commission a citizen of the county for which
the district is created, for a term of six years, to succeed the member
whose term expires on the June first next succeeding.
At the expiration of the term of each of the three members serv-
ing on the commission prior to June 1, 1963, the said governing
body shall, at a meeting held not later than one month prior to
January first in each year in which such a vacancy occurs, appoint
as a member of the Commission a citizen of the county for which
the district is created, for a term of six years and five months, to
succeed the member whose term expires on the January first next
succeeding. Thereafter, each appointment made to said commission
shall, at a meeting held not later than one month prior to June
first in each year in which a vacancy occurs, be made by said govern-
ing body for a term of six years from June first next succeeding.
