CHAPTER 405
(House Bill 460)

AN ACT to repeal and re-enact, with amendments, Section 9 of
Article 93 of the Annotated Code of Maryland (1957 Edition),
title "Testamentary Law," subtitle "Account"; Sections 109 and
128 of said Article, subtitle "Debts"; Section 174 of said Article,
subtitle "Guardian and Ward"; Sections 217 and 220 of said
Article, subtitle "Guardians and Infants Not Residing in This
State"; Section 241 of said Article, subtitle "Inventory and List
of Debts"; Section 261 of said Article, subtitle "Orphans' Court";
Section 292 of said Article, subtitle "Register of Wills"; and
Section 361 of said Article, subtitle "Wills"; to raise the amount
chargeable to a married woman's estate for her funeral expenses
from $300.00 to $500.00 in conformity with the general provisions
of Article 93, Sections 6 and 7; to extend the periods for payment
of claims by the administrator so as to conform this duty chrono-
logically with the companion duty to state accounts according to
Article 93, Sections 1 and 3; to delete the provisions for the fee
of the Register of Wills for making entries of claim and for docket-
ing charges so that such fees may be controlled by the provisions of
Article 36, Section 24; to delete the provisions favoring married
female minors in conformity with similar provisions contained in
the Acts of 1965, Chapter 257; to permit a nonresident guardian
of the estate of an infant to claim the property of such infant
situated in the State; to provide for the disposition, exempt from
appraisement, of the wearing apparel of the decedent, male or
female, and to exclude furs from the definition of wearing apparel;
to provide, in certain cases, for the transfer of certain boats or
vessels belonging to deceased persons by the Maryland Department
of Chesapeake Bay Affairs in addition to previous methods of
transfer without formal administration; and to delete the provi-
sions requiring the Registers of Wills and Clerks of Court to
maintain special books for the recording of releases of powers of
appointment and indices thereto.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 9 of Article 93 of the Annotated Code of Maryland
(1957 Edition), title "Testamentary Law," subtitle "Account";
Sections 109 and 128 of said Article, subtitle "Debts"; Section 174
of said Article, subtitle "Guardian and Ward"; Sections 217 and 220
of said Article, subtitle "Guardians and Infants Not Residing in This
State"; Section 241 of said Article, subtitle "Inventory and List of
Debts"; Section 261 of said Article, subtitle "Orphans' Court";
Section 292 of said Article, subtitle "Register of Wills"; and Section
361 of said Article, subtitle "Wills," be and they are hereby repealed
and re-enacted, with amendments, to read as follows:

9.

Whenever any married woman dies, or shall have died, her estate,
providing it be solvent, shall be liable for the payment of her funeral
expenses, to be allowed in the discretion of the court according to
the conditions and circumstances of the deceased, not to exceed
[three hundred ($300)] five hundred ($500) dollars, except by spe-
cial order of court. It shall be the duty of the executor or adminis-
